Proglašavam Zakon o potvrđivanju Konvencije o međunarodnoj trgovini
ugroženim vrstama divljih životinja i biljaka
(CITES), koji je donio Zastupnički dom Hrvatskoga državnog sabora na sjednici
24. rujna 1999.

Članak 1.
Potvrđuje se Konvencija o međunarodnoj trgovini ugroženim vrstama divljih životinja i biljaka (CITES), potpisana na međuvladinoj konferenciji u Washingtonu, D. C., 3. ožujka 1973. godine, koja je stupila na snagu 1. srpnja 1975. godine, a dopunjena je 1979. godine u Bonnu, zajedno s Amandmanom na članak XXI. Konvencije, donesenim 1983. godine u Gaboronu, Botswana.
Konvencija je u izvorniku pisana na engleskom, francuskom, kineskom, ruskom i španjolskom jeziku.
Članak 2.
Konvencija i Amandman na članak XXI. Konvencije u izvorniku na engleskom i u prijevodu na hrvatski jezik glase:

ŽIVOTINJA I BILJAKA

Stranke,
Uviđajući da su divlje životinje i biljke u svojim mnogostrukim izvanrednim i raznovrsnim oblicima nezamjenjivi dio zemljinih prirodnih sustava koji je potrebno štititi za ovu i za buduće generacije;
svjesne stalnorastuće vrijednosti divljih životinja i biljaka, s estetskog, znanstvenog, kulturnog, rekreacijskog i gospodarskog stajališta;
uviđajući da narodi i države jesu i moraju biti najbolji zaštitnici vlastitih divljih životinja i biljaka;
uviđajući, osim toga, da je međunarodna suradnja izuzetno važna za zaštitu određenih vrsta divljih životinja i biljaka od prekomjernog iskorištavanja putem međunarodne trgovine;
uvjerene u žurnost poduzimanja odgovarajućih mjera u tom smislu;
sporazumjele su se kako slijedi:
Članak I.
DEFINICIJE
Za potrebe ove Konvencije, ukoliko kontekst ne razumijeva drukčije:
(a) »Vrsta« znači bilo koju vrstu, podvrstu ili njezinu zemljopisno izdvojenu populaciju;
(b) »Primjerak« znači:
(i) bilo koju životinju ili biljku, bez obzira na to da li je živa ili mrtva;
(ii) u slučaju životinje: za vrste uključene u dodatke I. i II., bilo koji lako prepoznatljivi njezin dio ili derivat, a za vrste uključene u Dodatak III., bilo koji lako prepoznatljivi njezin dio ili derivat naveden u Dodatku III. za tu vrstu;
(iii) u slučaju biljke: za vrste uključene u Dodatak I., bilo koji lako prepoznatljivi njezin dio ili derivat, a za vrste uključene u dodatke II. i III. bilo koji lako prepoznatljivi njezin dio ili derivat naveden u dodacima II. i III. za tu vrstu;
(c) »Trgovina« znači izvoz/iznošenje, ponovni izvoz/iznošenje, uvoz/unošenje, te unošenje s mora;
(d) »Ponovni izvoz« znači izvoz/iznošenje svakoga primjerka koji je prethodno bio uvezen/unesen.
(e) »Unošenje s mora« znači prenošenje u državu primjeraka, bilo koje vrste, koji su bili uzeti iz morskog okoliša koji nije pod jurisdikcijom ni jedne države;
(f) »Znanstveno tijelo« znači državno znanstveno tijelo određeno u skladu s člankom LX.;
(g) »Ovlaštena uprava« znači državno upravno tijelo imenovano u skladu s člankom IX.;
(h) »Stranka« znači državu u kojoj je ova Konvencija stupila na snagu.
Članak II.
TEMELJNA NAČELA
1. Dodatak I. će uključivati sve vrste kojima prijeti izumiranje, a koje ugrožava ili može ugroziti, trgovina, Trgovina primjercima ovih vrsta mora biti podvrgnuta posebno strogim propisima, kako se ne bi dalje ugrožavao njihov opstanak, a smije se dopustiti samo u posebnim okolnostima.
2. Dodatak II. će uključivati:
(a) sve vrste kojima možda trenutačno ne prijeti izumiranje, ali se to može dogoditi ukoliko trgovina primjercima takvih vrsta ne bude podlijegala strogim propisima radi izbjegavanja njihova iskorištavanja na način koji ugrožava njihov opstanak;
(b) druge vrste koje moraju biti podložne propisima kako bi trgovina primjercima nekih vrsta navedenih u podstavku (a) ovoga stavka, bila podvrgnuta djelatnom nadzoru.
3. Dodatak III. će uključivati sve vrste koje bilo koja stranka utvrdi kao vrste koje podliježu propisima u okviru njezine jurisdikcije, s ciljem sprječavanja ili ograničavanja njihova iskorištavanja, i za nadzor čije trgovine joj je potrebna suradnja drugih stranaka.
4. Stranke neće dopustiti trgovinu primjercima vrsta sadržanih u dodacima I., II. i III., osim u skladu s odredbama ove Konvencije.
Članak III.
REGULIRANJE TRGOVINE PRIMJERCIMA VRSTA UKLJUČENIH U DODATAK I.
1. Cjelokupna trgovina primjercima vrsta uključenih u Dodatak I. odvijat će se u skladu s odredbama ovoga članka.
2. Izvoz/iznošenje svakoga primjerka vrste uključene u Dodatak I. razumijevat će prethodno izdavanje i predočenje izvoznog dopuštenja. Izvozno dopuštenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je znanstveno tijelo države izvoznice izdalo mišljenje da takav izvoz/iznošenje neće štetiti opstanku te vrste;
(b) ako je ovlaštena uprava države izvoznice uvjerena da se do primjerka nije došlo u suprotnosti sa državnim zakonima koji se odnose na zaštitu životinjskih i biljnih vrsta;
(c) ako je ovlaštena uprava države izvoznice uvjerena da će svi živi primjerci biti pripremljeni i isporučeni na takav način koji će smanjiti na najmanju mjeru mogućnost njihova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju;
(d) ako je ovlaštena uprava države izvoznice uvjerena da je izdano uvozno dopuštenje za taj primjerak.
3. Uvoz/unošenje svakog primjerka vrste uključene u Dodatak I. razumijevat će prethodno izdavanje i predočenje uvoznog dopuštenja, te izvoznog dopuštenja ili uvjerenja o ponovnom izvozu. Uvozno dopuštenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je znanstveno tijelo države uvoznice izdalo mišljenje da se primjerak uvozi/unosi u svrhe koje nisu štetne za opstanak te vrste;
(b) ako je znanstveno tijelo države uvoznice uvjereno da je predviđeni primalac živog primjerka na odgovarajući način opremljen za držanje i brigu o njemu;
(c) ako je ovlaštena uprava države uvoznice uvjerena da se primjerak neće koristiti u prvenstveno komercijalne svrhe.
4. Ponovni izvoz/iznošenje svakoga primjerka vrste uključene u Dodatak 1. razumijevat će prethodno izdavanje i predočenje uvjerenja o ponovnom izvozu. Uvjerenje o ponovnom izvozu će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je ovlaštena uprava države ponovnog izvoza uvjerena da je primjerak bio uvezen/unesen u tu državu u skladu s odredbama ove Konvencije;
(b) ako je ovlaštena uprava države ponovnog izvoza uvjerena da će svi živi primjerci biti pripremljeni i isporučeni na takav način koji će smanjiti na najmanju mjeru mogućnost njihova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju; i
(c) ako je ovlaštena uprava države ponovnog izvoza uvjerena da je izdano uvozno dopuštenje za svaki živi primjerak.
5. Unošenje s mora svakoga primjerka vrste uključene u Dodatak 1. razumijevat će prethodno izdavanje uvjerenja od strane ovlaštene uprave države u koju se primjerak unosi. Uvjerenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je znanstveno tijelo države u koju se primjerak unosi izdalo mišljenje da unošenje neće biti štetno za opstanak te vrste;
(b) ako je ovlaštena uprava države u koju se primjerak unosi uvjerena da je predviđeni primalac živog primjerka na odgovarajući način opremljen za držanje i brigu o njemu;
(c) ako je ovlaštena uprava države u koju se primjerak unosi uvjerena da se primjerak neće koristiti u prvenstveno komercijalne svrhe.
Članak IV.
REGULIRANJE TRGOVINE PRIMJERCIMA VRSTA UKLJUČENIH U DODATAK - II.
1. Cjelokupna trgovina primjercima vrsta uključenih u Dodatak II. će se odvijati u skladu s odredbama ovoga članka.
2. Izvoz/iznošenje svakoga primjerka vrste uključene u Dodatak II. razumijevat će prethodno izdavanje i predočenje izvoznog dopuštenja. Izvozno dopuštenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je znanstveno tijelo države izvoznice izdalo mišljenje da takav izvoz/iznošenje neće štetiti opstanku te vrste;
(b) ako je ovlaštena uprava države izvoznice uvjerena da se do primjerka nije došlo u suprotnosti sa državnim zakonima koji se odnose na zaštitu faune i flore;
(c) ako je ovlaštena uprava države izvoznice uvjerena da će svi živi primjerci biti pripremljeni i isporučeni na takav način koji će smanjiti na najmanju mjeru mogućnost njihova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju.
3. Znanstveno tijelo u svakoj stranki će nadzirati kako izdavanje izvoznih dopuštenja od strane države za primjerke vrsta uključenih u Dodatak II., tako i sam izvoz/iznošenje tih primjeraka. Kad god znanstveno tijelo utvrdi da je potrebno ograničiti izvoz/iznošenje primjeraka bilo koje vrste kako bi se ona održala u svojem području rasprostranjenja na razini koja je u skladu s njezinom ulogom u ekološkim sustavima u kojima se javlja, a znatno iznad razine na kojoj bi ta vrsta mogla ispunjavati uvjete za uključivanje u Dodatak 1., znanstveno tijelo će preporučiti odgovarajućoj ovlaštenoj upravi pogodne mjere koje treba poduzeti u svrhu ograničavanja izdavanja izvoznih dopuštenja, za primjerke te vrste.
4. Uvoz unošenja svakog primjerka vrste uključene u Dodatak II. razumijevat će prethodno predočenje izvoznog dopuštenja ili uvjerenja o ponovnom izvozu.
5. Ponovni izvoz svakoga primjerka vrste uključene u Dodatak II. razumijevat će prethodno izdavanje i predočenje uvjerenja o ponovnom izvozu. Uvjerenje o ponovnom izvozu će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je ovlaštena uprava države ponovnog izvoza uvjerena da je primjerak bio uvezen/unesen u tu državu u skladu s odredbama ove Konvencije;
(b) ako je ovlaštena uprava države ponovnog izvoza uvjerena da će svi živi primjerci biti pripremljeni i isporučeni na takav način koji će smanjiti na najmanju mjeru mogućnost njihova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju.
6. Unošenje s mora svakoga primjerka vrste uključene u Dodatak II. podrazumijevat će prethodno izdavanje uvjerenja od strane ovlaštene uprave države u koju se primjerak unosi. Uvjerenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je znanstveno tijelo države u koju se primjerak unosi izdalo mišljenje da unošenje neće biti štetno za opstanak te vrste;
(b) ako je ovlaštena uprava države u koju se primjerak unosi uvjerena da će se tim primjerkom rukovati na takav način koji će smanjiti na najmanju mjeru mogućnost njegova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju.
7. Uvjerenja navedena u stavku 6. ovoga članka mogu se izdavati po preporuci znanstvenoga tijela, u dogovoru s ostalim državnim znanstvenim tijelima ili, kad je to prikladno, s međunarodnim znanstvenim tijelima u svezi s ukupnim brojem primjeraka koji se mogu unijeti u razdoblju koje ne prelazi godinu dana.
Članak V.
REGULIRANJE TRGOVINE PRIMJERCIMA VRSTA UKLJUČENIH U DODATAK III.
1. Cjelokupna trgovina primjercima vrsta uključenih u Dodatak III. odvijat će se u skladu s odredbama ovoga članka.
2. Izvoz/iznošenje svakoga primjerka vrste uključene u Dodatak III. iz svake države koja je uključila tu vrstu u Dodatak III., razumijevat će prethodno izdavanje i predočenje izvoznog dopuštenja. Izvozno dopuštenje će se izdati samo ukoliko su ispunjeni sljedeći uvjeti:
(a) ako je ovlaštena uprava države izvoznice uvjerena da se do primjerka nije došlo u suprotnosti sa državnim zakonima koji se odnose na zaštitu životinjskih i biljnih vrsta;
(b) ako je ovlaštena uprava države izvoznice uvjerena da će svi živi primjerci biti pripremljeni i isporučeni na način koji će smanjiti na najmanju mjeru mogućnost njihova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju.
3. Uvoz/unošenje svakog primjerka vrste uključene u Dodatak III. razumijevat će, osim u uvjetima na koje se primjenjuje stavak 4. ovoga članka, prethodno predočenje uvjerenja o porijeklu i, ako se radi o uvozu/unošenju iz države koja je uključila tu vrstu u Dodatak IIII. izvoznog dopuštenja.
4. U slučaju ponovnog izvoza/iznošenja, država uvoza/unošenja prihvatit će uvjerenje koje je izdala ovlaštena uprava države ponovnog izvoza/iznošenja, da je primjerak bio proslijeđen u tu državu ili da se ponovno izvozi iznosi, kao dokaz da su bile poštivane odredbe ove Konvencije u odnosu na dan primjerak.
Članak VI.
DOPUŠTENJA I UVJERENJA
1. Dopuštenja i uvjerenja koja se izdaju na osnovi odredbi članaka III., IV. i V. moraju biti u skladu s odredbama ovoga članka.
2. Izvozno dopuštenje mora sadržavati podatke navedene u modelu prikazanom u Dodatku IV. i smije se koristiti za izvoz/iznošenje samo u razdoblju od šest mjeseci nakon datuma izdavanja.
3. Svako dopuštenje ili uvjerenje mora sadržavati ime ove Konvencije, ime i pečat ovlaštene uprave koja ga izdaje te kontrolni broj koji mu daje ovlaštena uprava.
4. Svaka kopija dopuštenja ili uvjerenja kojega izdaje ovlaštena uprava bit će jasno označena kao kopija i nijedna takva kopija se ne smije koristiti umjesto originala, osim u mjeri u kojoj je to uobičajeno.
5. Potrebno je posebno dopuštenje ili uvjerenje za svaku pošiljku primjeraka.
6. Ovlaštena uprava države uvoza/unošenja nekoga primjerka poništit će i zadržati izvozno dopuštenje ili uvjerenje o ponovnom izvozu i svako odgovarajuće uvozno dopuštenje predočeno u svezi s uvozom/unošenjem toga primjerka.
7. Gdje je to moguće i ostvarljivo, ovlaštena uprava može staviti oznaku na bilo koji primjerak radi njegove lakše identifikacije. U tu svrhu »oznaka« znači bilo kakav neizbrisivi otisak, olovni pečat ili drugo odgovarajuće sredstvo identificiranja primjerka, tako izrađeno da učini što težim njegovo krivotvorenje od strane neovlaštenih osoba.
Članak VII.
IZUZEĆA I OSTALE POSEBNE ODREDBE VEZANE ZA TRGOVINU
1. Odredbe članaka III., IV. i V. ne odnose se na tranzit ili pretovar primjeraka u slučaju prolaska preko ili zadržavanja na teritoriju stranke, dok su primjerci na carinskoj kontroli.
2. Kad je ovlaštena uprava države izvoza/iznošenja ili ponovnog izvoza/iznošenja uvjerena da je primjerak bio nabavljen prije nego su se odredbe ove Konvencije počele primjenjivati na taj primjerak, odredbe članaka III., IV. i V. neće se primjenjivati na taj primjerak, ukoliko ovlaštena uprava izda u tom smislu odgovarajuće uvjerenje.
3. Odredbe članaka III., IV. i V. neće se primjenjivati na primjerke koji su osobni ili kućanski predmeti. Ovo izuzeće se ne odnosi na slučajeve:
(a) kada se radi o primjercima vrsta uključenih u Dodatak 1., ukoliko ih je vlasnik nabavio izvan države u kojoj je stalno nastanjen, a unosi se u tu državu; ili
(b) kada se radi o primjercima vrsta uključenih u Dodatak II:
(i) ako ih je vlasnik nabavio izvan države u kojoj je stalno nastanjen, a u državi u kojoj su uzeti iz prirode;
(ii) ako se unose u državu u kojoj je vlasnik stalno nastanjen;
(iii) ako država u kojoj su uzeti iz prirode zahtijeva prethodno izdavanje izvoznog dopuštenja prije svakoga iznošenja takvih primjeraka;
ukoliko ovlaštena uprava nije uvjerena da su primjerci bili nabavljeni prije nego što su se odredbe ove Konvencije počele primjenjivati na predmetne primjerke.
4. Primjerci neke životinjske vrste uključene u Dodatak 1. koji su uzgojeni u zatočeništvu u komercijalne svrhe ili biljne vrste uključene u Dodatak 1. koje su umjetno uzgojene u komercijalne svrhe, smatrat će se primjercima vrsta uključenih u Dodatak II.
5. U slučaju kad je ovlaštena uprava države izvoza/iznošenja uvjerena da je primjerak životinjske vrste bio uzgojen u zatočeništvu ili primjerak biljne vrste bio umjetno uzgojen, odnosno da se radi o dijelu takve životinje ili biljke ili o njihovome derivatu, uvjerenje te ovlaštene uprave u tom smislu će se prihvatiti umjesto dopuštenja ili uvjerenja koja se traže na temelju odredbi članaka III., IV. ili V.
6. Odredbe članaka III., IV. i V. neće se primjenjivati na nekomercijalnu posudbu, poklon ili razmijenu među znanstvenicima ili znanstvenim ustanovama, registriranima kod ovlaštene uprave njihove države, primjeraka iz herbarija, drugih prepariranih, osušenih ili uloženih muzejskih primjeraka i živoga biljnog materijala, koji nose etiketu izdanu ili ovjerenu od ovlaštene uprave.
7. Ovlaštena uprava bilo koje države može zanemariti uvjete iz članka III., IV., V. i dozvoliti kretanje bez dopuštenja ili uvjerenja, za primjerke koji su sastavni dio putujućih zooloških vrtova, cirkusa, zvjerinjaka, izložbi biljaka ili drugih putujućih izložbi pod uvjetom:
(a) da izvoznik ili uvoznik registrira sve pojedinosti o takvim primjercima kod ovlaštene uprave;
(b) da primjerci spadaju u bilo koju od kategorija navedenih u stavcima 2. ili 5. ovoga članka;
(c) da je ovlaštena uprava uvjerena kako će svaki primjerak biti transportiran i zbrinut na takav način koji će smanjiti na najmanju mjeru mogućnost njegova ozljeđivanja, oštećenja zdravlja ili izlaganja okrutnom ponašanju.
Članak VIII.
MJERE KOJE TREBAJU PODUZIMATI STRANKE
1. Stranke će poduzeti odgovarajuće mjere za provođenje odredbi ove Konvencije i za zabranu trgovine primjercima koja se protivi istoj. To uključuje sljedeće mjere:
(a) kažnjavanje trgovine ili posjedovanja takvih primjeraka ili oboje;
(b) zapljenjivanje takvih primjeraka ili njihovo vraćanje državi izvoza.
2. Osim mjera koje poduzima u skladu sa stavkom 1. ovoga članka, stranka može, kada to smatra nužnim, osigurati načine interne nadoknade troškova nastalih kao posljedica zapljenjivanja primjerka kojim se trgovalo protivno mjerama koje se poduzimaju u primjeni odredbi ove Konvencije.
3. Koliko god je to moguće, stranke će osigurati da primjerci prođu kroz sve formalnosti obvezne prilikom trgovine, u što kraće vrijeme. Da bi se olakšao takav postupak, stranka može odrediti mjesta izlaza i mjesta ulaza u kojima primjerci moraju biti predočeni radi carinjenja. Stranke će nadalje osigurati da svi živi primjerci u svakom trenutku tranzita, zadržavanja ili utovara budu na odgovarajući način zbrinuti kako bi se smanjila na najmanju mjeru mogućnost njihova ozljeđivanja oštećenja zdravlja ili izlaganja okrutnom ponašanju.
4. U slučaju kad je živi primjerak zaplijenjen kao posljedica mjera navedenih u stavku 1. ovoga članka:
(a) primjerak će se povjeriti ovlaštenoj upravi države zapljene;
(b) ovlaštena uprava će, nakon konzultacije s državom izvoza, vratiti primjerak toj državi na trošak te države ili centru za spašavanje, odnosno nekom drugom mjestu kojega ovlaštena uprava smatra prikladnim i u skladu s ciljevima ove Konvencije;
(c) ovlaštena uprava može tražiti savjet od znanstvenoga tijela ili se može, kadgod to smatra potrebnim, konzultirati s Tajništvom u svrhu olakšavanja donošenja odluke iz podstavka (b) ovoga stavka, uključujući i izbor centra za spašavanje ili nekog drugog mjesta.
5. Centar za spašavanje iz stavka 4. ovoga članka razumijeva ustanovu koju ovlaštena uprava odredi za skrb o dobrobiti živih primjeraka, naročito onih koji su bili zaplijenjeni.
6. Svaka stranka će voditi dokumentaciju o trgovini primjercima vrsta uključenih u dodatke I., II. i III., a koja će sadržavati:
(a) imena i adrese izvoznika i uvoznika;
(b) broj i vrstu izdanih dopuštenja i uvjerenja; države s kojima se odvijala takva trgovina; brojeve ili količine i tipove primjeraka, imena vrsta onako kako su navedena u dodacima I., II., III. i gdje je to primjenjivo, veličinu i spol predmetnih primjeraka.
7. Svaka stranka će pripremati periodične izvještaje o provođenju ove Konvencije i dostavit će Tajništvu:
(a) godišnji izvještaj sa sažetkom podataka navedenih u podstavku (b) stavka 6. ovoga članka;
(b) dvogodišnji izvještaj o zakonodavnim i administrativnim mjerama poduzetim s ciljem provođenja odredbi ove Konvencije.
8. Podaci navedeni u stavku 7. ovoga članka stavit će se na uvid javnosti, ukoliko to nije u suprotnosti sa zakonom odnosne stranke.
Članak IX.
OVLAŠTENA UPRAVA I ZNANSTVENA TIJELA
1. Svaka stranka će za potrebe ove Konvencije odrediti:
(a) jednu ili više ovlaštenih uprava, za izdavanje dopuštenja ili uvjerenja u ime te stranke:
(b) jedno ili više znanstvenih tijela.
2. Država koja polaže instrument ratifikacije, prihvata, odobrenja ili pristupa, istovremeno će obavijestiti vladu kod koje polaže instrument, o imenu i adresi ovlaštene uprave određene za komuniciranje s ostalim strankama i s Tajništvom.
3. Odnosna stranka će obavijestiti Tajništvo o svakoj promjeni imenovanja ili ovlašćivanja u smislu odredbi ovoga članka, kako bi ono o tome obavijestilo sve ostale stranke.
4. Svaka ovlaštena uprava, navedena u stavku 2. ovoga članka će, ukoliko to od nje zatraži Tajništvo ili ovlaštena uprava druge stranke, dostaviti svoje otiske pečata ili druga sredstva kojima se ovjeravaju dopuštenja ili uvjerenja.
Članak X.
TRGOVINA S DRŽAVAMA KOJE NISU STRANKE KONVENCIJE
Kada se izvozi/iznosi ili ponovno izvozi/iznosi u, ili uvozi/unosi iz, države koja nije stranka ove Konvencije, svaka stranka može prihvatiti u zamjenu odgovarajuću dokumentaciju koju izdaju ovlaštena tijela u toj državi, a koja je bitno u skladu sa zahtijevima ove Konvencije u odnosu na dopuštenja i uvjerenja.
Članak XI.
KONFERENCIJA STRANAKA
1. Tajništvo će sazvati sastanak Konferencije stranaka najkasnije dvije godine od dana stupanja na snagu ove Konvencije.
2. Poslije toga Tajništvo će sazivati redovne sastanke najmanje jedamput svake druge godine, ukoliko Konferencija ne odluči drukčije, i izvanredne sastanke u bilo koje vrijeme na pisani zahtjev najmanje jedne trećine stranaka.
3. Na sastancima, bez obzira da li su redovni ili izvanredni, stranke će razmatrati provođenje ove Konvencije, te mogu:
(a) donijeti potrebne odredbe kako bi se omogućilo Tajništvu vršenje njegovih dužnosti, te usvojiti financijske odredbe;
(b) razmotriti i usvojiti amandmane na dodatke I. i II., u skladu s člankom XV;
(c) pregledati napredak postignut u zaštiti i očuvanju vrsta uključenih u dodatke I., II. i III;
(d) primiti i razmotriti sve izvještaje koje podnese Tajništvo ili bilo koja stranka;
(e) kada je to prikladno, dati preporuke za poboljšanje djelotvornosti ove Konvencije.
4. Na svakom redovnom sastanku, stranke mogu odrediti mjesto i vrijeme održavanja sljedećeg redovnog sastanka koji će se održati u skladu s odredbama stavka 2. ovoga članka.
5. Na svakom sastanku, stranke mogu utvrditi i usvojiti pravila procedure za sastanak.
6. Ujedinjeni narodi, njihove specijalizirane agencije i Međunarodna agencija za atomsku energiju kao i sve države koje nisu stranke ove Konvencije, mogu biti predstavljeni na sastancima Konferencije u svojstvu promatrača, koji će imati pravo sudjelovanja u radu, ali ne i pravo glasovanja.
7. Svako tijelo ili agencija tehnički osposobljena za zaštitu, očuvanje ili gospodarenje divljim životinjama i biljkama, uključena u sljedeće kategorije, a koja je obavijestila Tajništvo o svojoj želji da bude predstavljena na sastancima Konferencije u svojstvu promatrača, bit će prihvaćena, osim u slučaju da najmanje jedna trećina prisutnih stranaka to ospori:
(a) međunarodne agencije ili tijela, bilo vladina ili nevladina, te nacionalne vladine agencije i tijela;
(b) nacionalne vladine agencije ili tijela koja je država u kojoj imaju sjedište odobrila kao takve.
Kada jedanput budu prihvaćeni, ovi promatrači stječu pravo na sudjelovanje bez prava glasovanja.
Članak XII.
TAJNIŠTVO
1. Po stupanju na snagu ove Konvencije, izvršni direktor Programa za okoliš Ujedinjenih naroda formirat će Tajništvo. Do mjere i na način koji on smatra prikladnim, u tome mu mogu pomagati odgovarajuće međuvladine ili nevladine međunarodne ili nacionalne agencije i tijela koja su u tehničkom smislu osposobljena da osiguraju zaštitu, očuvanje i gospodarenje divljim životinjama i biljkama.
2. Funkcije Tajništva će biti sljedeće:
(a) da organizira i opslužuje sastanke stranaka;
(b) da obavlja sve funkcije koje su mu povjerene odredbama članaka XV. i XVI. ove Konvencije;
(c) da pokreće znanstvena i tehnička istraživanja u skladu s programima koje je odobrila Konferencija stranaka, a koja će doprinijeti provođenju ove Konvencije, uključujući i studije vezane za standarde za prikladnu pripremu i isporuku živih primjeraka i načine identificiranja primjeraka;
(d) da prouči izvještaje stranaka i da od njih traži sve dodatne informacije koje smatra potrebnima za osiguranje provođenja ove Konvencije;
(e) da skrene pažnju strankama na sva pitanja vezana za ostvarivanje ciljeva ove Konvencije;
(f) da periodično objavljuje i razašilje strankama važeća izdanja dodataka I., II. i III. zajedno sa svim podacima koji će olakšati identifikaciju primjeraka vrsta uključenih u te dodatke;
(g) da pripremi godišnje izvještaje strankama o svom radu i o provođenju ove Konvencije, te ostale izvještaje za potrebe sastanaka stranaka;
(h) da daje preporuke za provođenje ciljeva i odredbi ove Konvencije, uključujući i razmjenu informacija znanstvene i tehničke naravi;
(i) da izvršava i sve ostale funkcije koje mu povjere stranke.
Članak XIII.
MEĐUNARODNE MJERE
1. Kad se Tajništvo u svjetlu primljenih informacija uvjeri da neka vrsta uključena u dodatak I. ili II. trpi negativne posljedice od trgovine primjercima te vrste ili da se odredbe ove Konvencije ne provode djelatno, prenijet će takve informacije ovlaštenoj upravi stranke ili stranaka na koje se odnose.
2. Kad stranka primi informaciju navedenu u stavku 1. ovoga članka, obavijestit će čim prije Tajništvo o svim relevantnim činjenicama u mjeri u kojoj to dozvoljavaju njeni zakoni i gdje je to prikladno, predložiti aktivnosti za poboljšanje stanja. Tamo gdje stranka drži da je potrebna istraga, tu istragu može provesti jedna ili više osoba koje imaju izričito ovlaštenje te stranke.
3. Informacija koju dostavi stranka ili koja je rezultat istrage navedene u stavku 2. ovoga članka, bit će razmotrena na sljedećoj Konferenciji stranaka, koja može dati svaku preporuku što ju smatra prikladnom.
Članak XIV.
UTJECAJ NA NACIONALNO ZAKONODAVSTVO I MEĐUNARODNE KONVENCIJE
1. Odredbe ove Konvencije ni na koji način neće utjecati na pravo stranaka da usvoje:
(a) strože nacionalne mjere koje se odnose na uvjete trgovine, uzimanje iz prirode, posjedovanja ili prijevoza primjeraka vrsta uključenih u dodatke I., II. ili III. ili na njihovu potpunu zabranu;
(b) nacionalne mjere koje ograničavaju ili zabranjuju trgovinu, uzimanje iz prirode, posjedovanje ili prijevoz vrsta koje nisu uključene u dodatke I., II. ili III.
2. Odredbe ove Konvencije neće ni na koji način utjecati na odredbe nacionalnih mjera ili obaveza stranaka koje proistječu iz ugovora, konvencija ili međunarodnih sporazuma vezanih za druge aspekte trgovine, uzimanja iz prirode, posjedovanja ili prijevoza primjeraka, koji su na snazi ili naknadno mogu stupiti na snagu u stranki, uključujući i sve mjere koje se odnose na carinu, javno zdravlje i problematiku karantene biljaka ili životinja.
3. Odredbe ove Konvencije ni na koji način neće utjecati na odredbe ili obveze koje proistječu iz bilo kojeg ugovora, konvencije ili međunarodnog sporazuma zaključenog, ili koji može biti zaključen, između država koje tvore savez ili regionalni trgovinski ugovor koji uspostavlja ili održava zajedničku vanjsku carinsku kontrolu i ukida carinsku kontrolu između stranaka, ukoliko se odnose na države članice toga saveza ili ugovora.
4. Država koja je stranka ove Konvencije, a koja je također stranka nekog drugog ugovora, konvencije ili međunarodnog sporazuma koji je na snazi u vrijeme stupanja na snagu ove Konvencije i na temelju čijih se odredbi pruža zaštita morskim vrstama uključenim u Dodatak II., bit će oslobođena obaveza koje proistječu iz odredbi ove Konvencije u odnosu na trgovinu primjercima vrsta uključenih u Dodatak II., koje preuzimaju brodovi registrirani u toj državi u skladu s odredbama takvoga drugog ugovora, konvencije ili međunarodnog sporazuma.
5. Usprkos odredbama članaka III., IV. i V., svaki izvoz/iznošenje primjeraka koji se preuzimaju u skladu sa stavkom 4. ovoga članka, zahtijevat će samo uvjerenje ovlaštene uprave države u koju se primjerak unosi, o tome da je primjerak preuzet u skladu s odredbama drugog ugovora, konvencije ili međunarodnog sporazuma koji je u pitanju.
6. Ništa u ovoj Konvenciji neće ići na uštrb kodifikacije i donošenja zakona o moru od strane Konferencije Ujedinjenih naroda o Zakonu o moru, koja je bila sazvana u skladu s Rezolucijom 2750 C (XXV) Glavne skupštine Ujedinjenih naroda, kao ni na uštrb sadašnjih ili budućih potraživanja i pravnih stavova bilo koje države u svezi sa zakonom o moru, te prirodom i rasponom priobalnog pojasa i područja plovidbe pod njenom jurisdikcijom.
Članak XV.
AMANDMANI NA DODATKE I. I II.
1. Sljedeće odredbe će se primjenjivati u odnosu na amandmane na dodatke I. i II. na sastancima Konferencije stranaka:
(a) Svaka stranka može predložiti amandman na dodatak I. ili II. za razmatranje na sljedećem sastanku. Tekst predloženog amandmana će se dostaviti Tajništvu najmanje 150 dana prije početka sastanka. Tajništvo će se konzultirati s ostalim strankama i zainteresiranim tijelima o amandmanu u skladu s odredbama podstavaka (b) i (c) stavka 2. ovoga članka i prenijeti odgovor svim strankama najkasnije 30 dana prije početka sastanka.
(b) Amandmani će se usvajati dvotrećinskom većinom glasova stranaka koje su nazočne i glasuju. U tu svrhu »stranke koje su prisutne i glasuju« znači stranke koje prisustvuju sastanku i daju svoj glas za ili protiv. Stranke koje se suzdrže od glasovanja, neće se ubrojiti u dvotrećinsku većinu potrebnu za usvajanje amandmana.
(c) Amandmani usvojeni na sastanku stupit će na snagu 90 dana poslije sastanka za sve stranke osim onih koje izraze rezervu u skladu sa stavkom 3. ovoga članka.
2. Između sastanaka Konferencije stranaka primjenjivat će se sljedeće odredbe u odnosu na amandmane na dodatke I. i II.:
(a) Svaka stranka može predložiti amandman na dodatak I. ili II. za razmatranje između sastanaka, poštanskom procedurom određenom u ovome stavku.
(b) Kad su u pitanju morske vrste, Tajništvo će po primitku teksta predloženog amandmana odmah prenijeti isti strankama. Također će konzultirati međuvladina tijela koja imaju određenu funkciju vezanu za te vrste, posebno u svrhu osiguranja znanstvenih podataka koje ta tijela mogu pružiti i osiguranja koordinacije sa svim mjerama očuvanja koje ta tijela provode. Tajništvo će u što kraćem roku prenijeti strankama izražene stavove i prikupljene podatke od ovih tijela, kao i vlastite nalaze i preporuke.
(c) Kad su u pitanju vrste koje nisu morske, Tajništvo će po primitku teksta predloženog amandmana odmah prenijeti istim strankama, a nakon toga, što je moguće prije, i vlastite preporuke.
(d) Svaka stranka može, u roku od šezdeset dana nakon datuma kojega je Tajništvo prenijelo svoje preporuke strankama u skladu sa podstavcima (b) i (c) ovoga stavka, dostaviti Tajništvu primjedbe na predloženi amandman, zajedno sa svim relevantnim znanstvenim podacima i informacijama.
(e) Tajništvo će čim prije prenijeti strankama primljene odgovore zajedno sa vlastitim preporukama.
(f) Ukoliko Tajništvo ne primi nikakav prigovor na predloženi amandman u roku 30 dana od dana kad odgovori i preporuke budu dostavljeni u skladu s odredbom podstavka (e) ovoga stavka, amandman će stupiti na snagu 90 dana nakon toga za sve stranke osim onih koje izraze rezervu u skladu sa stavkom 3. ovoga članka.
(g) Ukoliko Tajništvo primi prigovor od bilo koje stranke, predloženi amandman će se dostaviti na glasovanje poštanskim putem u skladu s odredbama podstavaka (h), (i) i (j) ovoga stavka.
(h) Tajništvo će obavijestiti stranke da je primljena obavijest o uloženom prigovoru.
(i) Ukoliko Tajništvo ne primi glasove za, protiv ili uzdržane od najmanje jedne polovice stranaka, u roku 60 dana od dana obavještavanja u skladu s podstavkom (h) ovoga stavka, predloženi amandman će se proslijediti sljedećem sastanku Konferencije na dalje razmatranje.
(j) Pod uvjetom da su primljeni glasovi od jedne polovice stranaka, amandman će se usvojiti dvotrećinskom većinom glasova stranaka koje su dale svoj glas za ili protiv.
(k) Tajništvo će obavijestiti sve stranke o rezultatima glasovanja.
(l) Ako se predloženi amandman usvoji, stupit će na snagu 90 dana nakon dana kad Tajništvo pošalje obavijest da je usvojen, za sve stranke osim za one koje su izrazile rezervu u skladu sa stavkom 3. ovoga članka.
3. U razdoblju od 90 dana kojega predviđa podstavak (c) stavka 1. ili postavak (l) stavka 2. ovoga članka, svaka stranka može izraziti rezervu u odnosu na amandman, putem pisane obavijesti, vladi depozitaru. Sve dok se takva rezerva ne povuče, stranka će se smatrati državom koja nije stranka ove Konvencije u odnosu na trgovinu predmetnim vrstama.
Članak XVI.
DODATAK III. I AMANDMANI NA NJEGA
1. Svaka stranka može u bilo koje vrijeme podnijeti Tajništvu popis vrsta za koje utvrdi da su podložne regulativi u okviru njezine jurisdikcije koja se odnosi na ciljeve navedene u stavku 3. članka II. Dodatak III. će uključivati imena stranaka koje podnose popis vrsta za uključivanje u isti, znanstvena imena vrsta tako podnesenih, kao i svih dijelova ili derivata predmetnih životinja ili biljaka koji su specificirani u odnosu na pojedinu vrstu u smislu podstavka (b) članka I.
2. Tajništvo će prenijeti svaki popis podnesen u skladu s odredbama stavka 1. ovoga članka, strankama, čim prije pošto ga primi. Popis će postati pravovaljan kao dio Dodatka III. 90 dana od dana takvoga prenošenja. U bilo koje vrijeme poslije obavještavanja o takvom spisku, svaka stranka može putem pisane obavijesti vladi depozitaru izraziti rezervu u odnosu na bilo koju vrstu ili dio ili derivat i sve dok se takva rezerva ne povuče ta država će se smatrati državom koja nije stranka ove Konvencije u odnosu na trgovinu predmetnom vrstom ili dijelom ili derivatom.
3. Stranka koja je podnijela neku vrstu za uključivanje u Dodatak III. može je povući u bilo koje vrijeme putem obvijesti upućene Tajništvu, koje će obavijestiti sve stranke o povlačenju. Povlačenje će stupiti na snagu 30 dana nakon dana obavještavanja.
4. Svaka stranka koja podnosi popis u skladu s odredbama stavka 1. ovoga članka, podnijet će Tajništvu kopiju svih domaćih zakona i propisa koji se odnose na zaštitu tih vrsta, zajedno sa svim tumačenjima koje smatra prikladnima ili koje zatraži Tajništvo. Stranka će, sve dok su predmetne vrste uključene u Dodatak III. podnositi svaku izmjenu ili dopunu tih zakona i propisa ili njihovo novo tumačenje, onako kako budu usvajani.
Članak XVII.
AMANDMANI NA KONVENCIJU
1. Tajništvo će sazvati izvanredni sastanak Konferencije stranaka na pisani zahtjev najmanje jedne trećine stranaka, radi razmatranja i usvajanja amandmana na ovu Konvenciju. Ti amandmani će se usvajati dvotrećinskom većinom glasova stranaka koje su nazočne i glasuju. U tu svrhu, »stranke koje su nazočne i glasuju« znači stranke koje su nazočne sastanku i daju svoj glas za ili protiv. Stranke koje se suzdrže od glasovanja neće se ubrojiti u dvotrećinsku većinu potrebnu za usvajanje amandmana.
2. Tajništvo će prenijeti tekst svakoga predloženog amandmana svim strankama najmanje 90 dana prije sastanka.
3. Za stranke koje su ga prihvatile, amandman će stupiti na snagu 60 dana pošto dvije trećine stranaka polože instrument prihvaćanja amandmana kod vlade depozitara. Poslije toga, za svaku drugu stranku amandman će stupiti na snagu 60 dana pošto ta stranka položi svoj instrument prihvaćanja amandmana.
Članak XVIII.
RJEŠAVANJE SPOROVA
1. Svi sporovi do kojih može doći između dviju ili više stranaka u svezi s tumačenjem ili primjenom odredbi ove Konvencije, rješavat će se pregovorima između stranaka u sporu.
2. Ukoliko se spor ne može riješiti u skladu sa stavkom 1. ovoga članka, stranke mogu uz uzajamnu suglasnost predati spor na arbitražu, prije svega Stalnom arbitražnom sudu u Haagu, čija će arbitražna odluka biti obvezujuća za stranke u sporu.
Članak XIX.
POTPISIVANJE
Ova Konvencija će biti otvorena za potpisivanje u Washingtonu do 30. travnja 1973., a poslije toga u Bernu do 31. prosinca 1974. godine.
Članak XX.
RATIFIKACIJA, PRIHVAT, ODOBRENJE
Ova Konvencija će podlijegati ratifikaciji, prihvatu ili odobrenju. Instrumenti ratifikacije, prihvata ili odobrenja će biti položeni kod vlade Švicarske konfederacije, koja će biti vlada depozitar.
Članak XXI.
PRISTUP
Ova Konvencija će biti otvorena za pristup na neograničeno vrijeme. Instrumenti pristupa će biti položeni kod vlade depozitara.
Članak XXII.
STUPANJE NA SNAGU
1. Ova Konvencija će stupiti na snagu 90 dana nakon polaganja desetog instrumenta ratifikacije, prihvata, odobrenja ili pristupa kod vlade depozitara.
2. Za svaku državu koja ratificira, prihvati ili odobri ovu Konvenciju ili joj pristupi poslije polaganja desetog instrumenta ratifikacije, prihvata, odobrenja ili pristupa, Konvencija će stupiti na snagu 90 dana pošto ta država položi instrument ratifikacije, prihvata, odobrenja ili pristupa.
Članak XXIII.
REZERVE
1. Odredbe ove Konvencije ne podliježu općim rezervama. Posebne rezerve se mogu izraziti u skladu s odredbama ovoga članka te članaka XV. i XVI.
2. Svaka država može, prilikom polaganja svojega instrumenta ratifikacije, prihvata, odobrenja ili pristupa, izraziti posebnu rezervu u odnosu na:
(a) bilo koju vrstu uključenu u dodatak I., II. ili III., ili
(b) bilo koji dio ili derivat specificiran u odnosu na neku vrstu uključenu u Dodatak III.
3. Sve dok stranka ne povuče svoju rezervu, izraženu u skladu s odredbama ovoga članka, smatrat će se državom koja nije stranka ove Konvencije u odnosu na trgovinu određenim vrstama ili dijelovima ili derivatima navedenima u takvoj rezervi.
Članak XXIV.
OTKAZIVANJE
Svaka stranka može u bilo koje vrijeme otkazati sudioništvo u ovoj Konvenciji putem pisane obavijesti vladi depozitaru. Otkazivanje će stupiti na snagu dvanaest mjeseci pošto je vlada depozitar primila obavijest.
Članak XXV.
DEPOZITAR
1. Izvornik ove Konvencije na kineskom, engleskom, francuskom, ruskom i španjolskom jeziku, čije su verzije podjednako autentične, bit će položen kod vlade depozitara, koja će dostaviti njezine ovjerene preslike svim državama koje su je potpisale ili položile instrument pristupanja.
2. Vlada depozitar će obavijestiti sve države potpisnice i pristupnice kao i Tajništvo, o potpisima, polaganjima instrumenata ratifikacije, prihvata, odobrenja ili pristupa, stupanju na snagu ove Konvencije, amandmanima na Konvenciju, podnošenju i povlačenju rezervi, te obavijestima o otkazivanju.
3. Čim ova Konvencija stupi na snagu, vlada depozitar će njezin ovjeren preslik proslijediti Tajništvu Ujedinjenih naroda radi registracije i objavljivanja u skladu sa člankom 102. Povelje Ujedinjenih naroda.
U POTVRDU TOGA su niže potpisani opunomoćenici, propisno za to ovlašteni, potpisali ovu Konvenciju.

Članak XXI.
PRISTUP
Ova Konvencija će biti otvorena za pristup na neograničeno vrijeme. Instrumenti pristupa će biti položeni kod vlade depozitara.
1. Ova Konvencija će biti otvorena za pristup na neograničeno vrijeme organizacijama regionalne ekonomske integracije, utemeljenima od strane suverenih država, koje su nadležne za dogovaranje, sklapanje i primjenu međunarodnih sporazuma u odnosu na problematiku koju je na njih prenijela njihova država članica, a koju pokriva ova Konvencija.
2. U svojim instrumentima pristupa, takve organizacije će izjaviti opseg svoje ovlasti u odnosu na problematiku koju pokriva ova Konvencija. Ove oganizacije će također obavijestiti depozitara o svakoj značajnoj promjeni opsega svoje ovlasti.
Depozitar će razaslati strankama obavijesti organizacija regionalne ekonomske integracije o njihovoj ovlasti u odnosu na problematiku koju pokriva ova Konvencija i o promjenama opsega ovlasti.
3. Kad je riječ o problematici koja je u njihovoj ovlasti, takve organizacije regionalne ekonomske integracije će koristiti prava i ispunjavati obveze koje ova Konvencija osigurava njihovim državama članicama koje su stranke Konvencije. U takvim slučajevima države članice organizacija neće biti ovlaštene za pojedinačno korištenje tih prava.
4. U granicama svoje ovlasti, organizacije regionalne ekonomske integracije koristit će svoje pravo glasovanja s brojem glasova koji je jednak broju njihovih država članica koje su stranke Konvencije. Te organizacije neće koristiti svoje pravo glasovanja ako njihove države članice budu glasovale i obrnuto.
5. Svako spominjanje »stranke« u smislu navedenom u članku I. (h) ove Konvencije, »države«/»država« ili »države stranke«/»država stranaka« Konvencije, tumačit će se tako da uključuje i svaku organizaciju regionalne ekonomske integracije koja ima ovlasti za dogovaranje, zaključivanje i primjenu međunarodnih sporazuma u odnosu na problematiku koju pokriva ova Konvencija.

Recognizing that wild fauna and flora in their many beautiful and varied forms are an irreplaceable part of the natural systems of the earth which must be protected for this and the generations to come;
Conscious of the ever-growing value of wild fauna and flora from aesthetic, scientific, cultural, recreational and economic points of view;
Recognizing that peoples and States are and should be the best protectors of their own wild fauna and flora;
Recognizing, in addition, that international co-operation is essential for the protection of certain species of wild fauna and flora against over-exploitation through international trade;
Convinced of the urgency of taking appropriate measures to this end;
Have agreed as follows:
Article I
DEFINITIONS
For the purpose of the present Convention, unless the context otherwise requires:
(a) »Species« means any species, subspecies, or geographically separate population thereof;
(b) »Specimen« means:
(i) any animal or plant, whether alive or dead;
(ii) in the case of an animal: for species included in Appendices I and II, any readily recognizable part or derivative thereof; and for species included in Appendix III, any readily recognizable part or derivative thereof specified in Appendix III in relation to the species; and
(iii) in the case of a plant: for species included in Appendix I, any readily recognizable part or derivative thereof; and for species included in Appendices II and III, any readily recognizable part or derivative thereof specified in Appendices II and III in relation to the species;
(c) »Trade« means export, re-export, import and introduction from the sea;
(d) »Re-export« means export of any specimen that has previously been imported;
e) »Introduction from the sea« means transportation into a State of specimens of any species which were taken in the marine environment not under the jurisdiction of any State;
(f) »Scientific Authority« means a national scientific authority designated in accordance with Article IX;
(g) »Management Authority« means a national management authority designated in accordance with Article IX;
(h) »Party« means a State for which the present Convention has entered into force.
Article II
FUNDAMENTAL PRINCIPLES
1. Appendix I shall include all species threatened with extinction which are or may be affected by trade. Trade in specimens of these species must be subject to particularly strict regulation in order not to endenger further their survival and must only be authorized in exceptional circumstances.
2. Appendix II shall include:
(a) all species which although not necessarily now threatened with extinction may become so unless trade in specimens of such species is subject to strict regulation in order to avoid utilization incompatible with their survival; and
b) other species which must be subject to regulation in order that trade in specimens of certain species referred to in sub-paragraph (a) of this paragraph may be brought under effective control.
3. Appendix III shall include all species which any Party identifies as being subject to regulation within its jurisdiction for the purpose of preventing or restricting exploitation, and as needing the co-operation of other Parties in the control of trade.
4. The Parties shall not allow trade in specimens of species included in Appendices I, II and III except in accordance with the provisions of the present Convention.
Article III
REGULATION OF TRADE IN SPECIMENS OF SPECIES INCLUDED IN APPENDIX I
1. All trade in specimens of species included in Appendix I shall be in accordance with the provisions of this Article.
2. The export of any specimen of a species included in Appendix I shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:
(a) a Scientific Authority of the State of export has advised that such export will not be detrimental to the survival of that species;
b) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora;
c) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and
(d) a Management Authority of the State of export is satisfied that an import permit has been granted for the specimen.
3. The import of any specimen of a species included in Appendix I shall require the prior grant and presentation or an import permit and either an export permit or a re-export certificate. An import permit shall only be granted when the following conditions have been met:
(a) a Scientific Authority of the State of import has advised that the import will be for purposes which are not detrimental to the survival of the species involved;
b) a Scientific Authority of the State of import is satisfied that the proposed recipient of a living specimen is suitably equipped to house and care for it: and
c) a Management Authority of the State of import is satisfied that the specimen is not to be used for primarily commercial purposes.
4. The re-export of any specimen of a species included in Appendix I shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met:
(a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provisions of the present Convention;
(b) a Management Authority of the State of re-export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and
(c) a Management Authority of the State of re-export is satisfied that an import permit has been granted for any living specimen.
5. The introduction from the sea of any specimen of a species included in Appendix I shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met:
(a) a Scientific Authority of the State of introduction advises that the introduction will not be detrimental to the survival of the species involved;
(b) a Management Authority of the State of introduction is satisfied that the proposed recipient of a living specimen is suitably equipped to house and care for it; and
c) a Management Authority of the State of introduction is satisfied that the specimen is not to be used for primarily commercial purposes.
Article IV
REGULATION OF TRADE IN SPECIMENS OF SPECIES INCLUDED IN APPENDIX II
1. All trade in specimens of species included in Appendix II shall be in accordance with the provisions of this Article.
2. The export of any specimen of a species included in Appendix II shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:
(a) a Scientific Authority of the State of export has advised that such export will not be detrimental to the survival of that species;
(b) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of the State for the protection of fauna and flora; and
(c) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.
3. A Scientific Authority in each Party shall monitor both the export permits granted by that State for specimens of species included in Appendix II and the actual exports of such specimens. Whenever a Scientific Authority determines that the export of specimens of any such species should be limited in order to maintain that species throughout its range at a level consistent with its role in the ecosystems in which it occurs and well above the level at which that species might become eligible for inclusion in Appendix I, the Scientific Authority shall advise the appropriate Management Authority of suitable measures to be taken to limit the grant of export permits, for specimens of that species.
4. The import of any specimen of a species included in Appendix II shall require the prior presentation of either an export permit or a re-export certificate.
5. The re-export of any specimen of a species included in Appendix II shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met:
(a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provisions of the present Convention; and
(b) a Management Authority of the State of re-export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.
6. The introduction from the sea of any specimen of a species included in Appendix II shal require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met:
(a) a Scientific Authority of the State of introduction advises that the introduction will not be detrimental to the survival of the species involved; and
(b) a Management Authority of the State of introduction is satisfied that any living specimen will be so handled as to minimize the risk of injury, damage to health or cruel tretment.
7. Certificates referred to in paragraph 6 of this Article may be granted on the advice of a Scientific Authority, in consultation with other national scientific authorities or, when appropriate, international scientific authorities, in respect of periods not exceeding one year for total numbers of specimens to be introduced in such periods.
Article V
REGULATION OF TRADE IN SPECIMENS OF SPECIES INCLUDED IN APPENDIX III
1. All trade in specimens of species included in Appendix III shall be in accordance with the provisions of this Article.
2. The export of any specimen of a species included in Appendix III from any State which has included that species in Appendix III shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:
(a) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora; and
(b) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.
3. The import of any specimen of a species included in Appendix III shall require, except in circumstances to which paragraph 4 of this Article applies, the prior presentation of a certificate of origin and, where the import is from a State which has included that species in Appendix III, an export permit.
4. In the case of re-export, a certificate granted by the Management Authority of the State of re-export that the specimen was processed in that State or is being re-exported shall be accepted by the State of import as evidence that the provisions of the present Convention have been complied with in respect of the specimen concerned.
Article VI
PERMITS AND CERTIFICATES
1. Permits and certificates granted under the provisions of Articles III, IV, and V shall be in accordance with the provisions of this Article.
2. An export permit shall contain the information specified in the model set forth in Appendix IV, and may only be used for export within a period of six months from the date on which it was granted.
3. Each permit or certificate shall contain the title of the present Convention, the name and any identifying stamp of the Management Authority granting it and a control number assigned by the Management Authority.
4. Any copies of a permit of certificate issued by a Management Authority shall be clearly marked as copies only and no such copy may be used in place of the original, except to the extent endorsed thereon.
5. A separate permit or certificate shall be required for each consignment of specimens.
6. A Management Authority of the State of import of any specimen shall cancel and retain the export permit or re-export certificate and any corresponding import permit presented in respect of the import of the specimen.
7. Where appropriate and feasible a Management Authority may affix a mark upon any specimen to assist in identifying the specimen. For these purposes »mark« means any indelible imprint, lead seal or other sultable means of identifying a specimen, designed in such a way as to render its imitation by unauthorized persons as difficult as possible.
Article VII
EXEMPTIONS AND OTHER SPECIAL PROVISIONS RELATING TO TRADE
1. The provisions of Articles III, IV and V shall not apply to the transit or transhipment of specimens through or in the territory of a Party while the specimens remain in Customs control.
2. Where a Management Authority of the State of export or re-export is satisfied that a specimen was acquired before the provisions of the present Convention applied to that specimen, the provisions of Articles III, IV and V shall not apply to that specimen where the Management Authority issues a certificate to the effect.
3. The provisions of Articles III, IV and V shall not apply to specimens that are personal or household effects. This exemption shall not apply where:
(a) in the case of specimens of a species included in Appendix I, they were acquired by the owner outside his State of usual residence, and are being imported into that State; or
(b) in the case of specimens of species included in Appendix II:
(i) they were acquired by the owner outside his State of usual residence and in a State where removal from the wild occurred;
(ii) they are being imported into the owneržs State of usual residence; and
(iii) the State where removal from the wild occurred requires the prior grant of export permits before any export of such specimens;
unless a Management Authority is satisfied that the specimens were acquired before the provisions of the present Convention applied to such specimens.
4. Specimens of an animal species included in Appendix I bred in captivity for commercial purposes, or of a plant species included in Appendix I artificially propagated for commercial purposes, shall be deemed to be specimens of species included in Appendix II.
5. Where a Management Authority of the State of export is satisfied that any specimen of an animal species was bred in captivity or any specimen of a plant species was artificially propagated, or is a part of such an animal or plant or was derived therefrom, a certificate by that Management Authority to that effect shall be accepted in lieu of any of the permits or certificates required under the provisions of Article III, IV or V.
6. The provisions of Articles III, IV and V shall not apply to the non-commercial loan, donation or exchange between scientists or scientific institutions registered by a Management Authority of their State, of herbarium specimens, other preserved, dried or embedded museum specimens, and live plant material which carry a label issued or approved by a Management Authority.
7. A Management Authority of any State may walve the requirements of Articles III, IV and V and allow the movement without permits or certificates of specimens which form party of a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition provided that:
(a) the exporter or importer registers full details of such specimens with that Management Authority;
(b) the specimens are in either of the categories specified in paragraph 2 or 5 of this Article; and
(c) the Management Authority is satisfied that any living specimen will be so transported and cared for as to minimize the risk of injury, damage to health or cruel treatment.
Article VIII
MEASURES TO BE TAKEN BY THE PARTIES
1. The Parties shall take appropriate measures to enforce the provisions of the present Convention and to prohibit trade in specimens in violation thereof. These shall include measures:
(a) to penalize trade in, or possession of, such specimens, or both; and
(b) to provide for confiscation or return to the State of export of such specimens.
2. In addition to the measures taken under paragraph 1 of this Article, a Party may, when it deems it necessary, provide for method of intemal reimbursement for expenses incurred as a result of the confiscation of a specimen traded in violation of measures taken in the application of the provisions of the present Convention.
3. As far as possible, the Parties shall ensure that specimens shall pass through any formalities required for trade with a minimum of delay. To facilitate such passage, a Party may designate ports of exit and ports of entry at which specimens must be presented for clearance. The Parties shall ensure further that all living specimens, during any period of transit, holding or shipment, are properly cared for so as to minimize the risk of injury, damage to health or cruel treatment.
4. Where a living specimen is confiscated as a result of measures referred to in paragraph 1 of this Article:
(a) the specimen shall be entrusred to a Management Authority of the State of confiscation;
(b) the Management Authority shall, after consultation with the State of export, return the specimen to that State at the expense of that State, or to a rescue centre or such other place as the Management Authority deems appropriate and consistent with the purposes of the present Convention; and
(c) the Management Authority may obtain the advice of a Scientific Authority, or may, whenever it considers it desirable, consult the Secretariat in order to facilitate the decision under sub-paragraph (b) of this paragraph, including the choice of a rescue centre or other place.
5. Arescue centre as referred to in paragraph 4 of this Article means an institution designated by a Management Authority to look after the welfare of living specimens, particularly those that have been confiscated.
6. Each Party shall maintain records of trade in specimens of species included in Appendices I, II and III which shall cover:
(a) the names and addresses of exporters and importers; and
(b) the number and type of permits and certificates granted; the States with which such trade occurred; the numbers or quantities and types of specimens, names of species as included in Appendices I, II and III and, where applicable, the size and sex of the specimens in question.
7. Each Party shall prepare periodic reports on its implementation of the present Convention and shall transmit to the Secretariat:
(a) an annual report containing a summary of the information specified in sub-paragraph (b) of paragraph 6 of this Article; and
(b) a biennial report on legislative, regulatory and administrative measures taken to enforce the provisions of the present Convention.
8. The information referred to in paragraph 7 of this Article shall be available to the public where this is not inconsistent with the law of the Party concerned.
Article IX
MANAGEMENT AND SCIENTIFIC AUTHORITIES
1. Each Party shall designate for the purposes of the present Convention:
(a) one or more Management Authorities competent to grant permits or certificates on behalf of that Party; and
(b) one or more Scientific Authorities.
2. A State depositing an instrument or ratification, acceptance, approval or accession shall at that time inform the Depositary Government of the name and address of the Management Authority authorized to communicate whit other Parties and with the Secretariat.
3. Any changes in the designations or authorizations under the provisions of this Article shall be communicated by the Party concerned to the Secretariat for transmission to all other Parties.
4. Any Management Authority referred to in paragraph 2 of this Article shall, if so requested by the Secretariat or the Management Authority of another Party, communicate to it impression of stamps, seals or other devices used to authenticate permits or certificates.
Article X
TRADE WITH STATES NOT PARTY TO THE
CONVENTION
Where export or re-export is to, or import is from, a State not a Party to the present Convention, comparable documentation issued by the competent authorities in that State which substantially conforms with the requirements of the present Convention for permits and certificates may be accepted in lieu thereof by any Party.
Article XI
CONFERENCE OF THE PARTIES
1. The Secretariat shall call a meeting of the Conference of the Parties not later than two years after the entry into force of the present Convention.
2. Thereafter the Secretariat shall convene regular meetings at least once every two years, unless the Conference decides otherwise, and extraordinary meetings at any time on the written request of a least one-third of the Parties.
3. At meetings, whether regular or extraordinary, the Parties shall review the implementation of the present Convention and may:
(a) make such provision as may be necessary to enable the Secretariat to carry out its duties, and adopt financial provisions;
(b) consider and adopt amendments to Appendices I and II in accordance with Article XV;
(c) review the progress made to wards the restoration and convervation of the species included in Appendices I, II and III;
(d) receive and consider any reports presented by the Secretariat or by any Party; and
(e) where appropriate, make recommendations for improving the effectiveness of the present Convention.
4. At each regular meeting, the Parties may determine the time and venue of the next regular meeting to be held in accordance with the provisions of paragraph 2 of this Article.
5. At any meeting, the Parties may determine and adopt rules of procedure for the meeting.
6. The United Nations, its Specialized Agencies and the International Atomic Energy Agency, as well as any State not a Party to the present Convention, may be represented at meetings of the Conference by observers, who shall have the right to participate but not to vote.
7. Any body or agency technically qualified in protection, conservation or management of wild fauna and flora, in the following categories, which has informed the Secretariat of its desire to be represented at meetings of the Conference by observers, shall be admitted unless at least one-third of the Parties present object:
(a) international agencies or bodies, either governmental or non-governmental, and national governmental agencies and bodies; and
(b) national non-governmental agencies or bodies which have been approved for this purpose by the State in which they are located.
Once admitted, these observers shall have the right to participate but not to vote.
Article XII
THE SECRETARIAT
1. Upon entry into force of the present Convention, a Secretariat shall be provided by the Executive Director of the United Nations Environment Programme. To the extent and in the manner he considers appropriate, he may be assisted by suitable inter-governmental or non-governmental international or national agencies and bodies technically qualified in protection, conservation and management of wild fauna and flora.
2. The functions of the Secretariat shall be:
(a) to arrange for and service meetings of the Parties;
(b) to perform the functions entrusted to it under the provisions of Articles XV and XVI of the present Convention;
(c) to undertake scientific and technical studies in accordance with programmes authorized by the Conference of the Parties as will contribute to the implementation of the present Convention, including studies concerning standards for appropriate preparation and shipment of living specimens and the means of identifying specimens;
(d) to study the reports of Parties and to request from Parties such further information with respect thereto as it deems necessary to ensure implementation of the present Convention;
(e) to invite the attention of the Parties to any matter pertaining to the aims of the present Convention;
(f) to publish periodically and distribute to the Parties current editions of Appendices I, II and III together with any Information which will facilitate Identification of specimens of species included in those Appendices;
(g) to prepare annuel reports to the Parties on its work and on the implementation of the present Convention and such other reports as meetings of the Parties may request;
(h) to make recommendations for the implementation of the aims and provisions of the present Convention, including the excange of information of a scientific or technical nature;
(i) to perform any other function as may be entrusted to it by the Parties.
Article XIII
INTERNATIONAL MEASURES
1. When the Secretariat in the light of information received is satisfied that any species included in Appendix I or II is being affected adversely by trade in specimens of that species or that the provisions of the present Convention are not being effectively implemented, it shall communicate such information to the authorized Management Authority of the Party or Parties concerned.
2. When any Party receives a communication as indicated in paragraph 1 of this Article, it shall, as soon as possible, inform the Secretariat of any relevant facts insofar as its laws permit and, where appropriate, propose remedial action. Where the Party considers that an inquiry is desirable, such inqulry may be carried out by one or more persons expressly authorized by the Party.
3. The information provided by the Party or resulting from any inquiry as specified in paragraph 2 of this Article shall be reviewed by the next Conterence of the Parties which may make whatever recommendations it deems appropriate.
Article XIV
EFFECT ON DOMESTIC LEGISLATION AND INTERNATIONAL CONVENTIONS
1. The provisions of the present Convention shall in on way affect the right of Parties to adopt:
(a) stricter domestic measures regarding the conditions for trade, taking, possession or tranport specimens of species included in Appendices I, II and III, or the complete prehibition thereof or
(b) domestic measures restricting or prohibiting trade, taking, possession or transport of species not included in Appendix I, II or III.
2. The provisions of the present Convention shall in no way affect the provisions of any domestic measures or the obligations of Parties deriving from any treaty, convention, or international agreement relating to other aspects of trade, taking, possession or transport of specimens which is in force or subsequently may enter into force for any Party including any measure pertaining to the Customs, public health, veterinary or plant quarantine fields.
3. The provisions of the present Convention shall in no way affect the provisions of, or the obligations deriving from, any treaty, convention or international agreement concluded or which may be concluded between States creating a union or regional trade agreement establishing or maintaining a common external Customs control and removing Customs control between the parties thereto insofar as they relate to trade among the States members of that union or agreement.
4. A State party to the present Convention, which is also a party to any other treaty, convention or international agreement which is in force at the time of the coming into force of the present Convention and under the provisions of which protection is afforded to marine species included in Appendix II, shall be relieved of the obligations imposed on it under the provisions of the present Convention with respect to trade in specimens of species included in Appendix II that are taken by ships registered in that State and in accordance with the provisions of such other treaty, convention or international agreement.
5. Notwithstanding the provisions of Articles III, IV and V, any export of a specimen taken in accordance with paragraph 4 of this Article shall only require a certificate from a Management Authority of the State of Introduction to the effect that the specimen was taken in accordance with the provisions of the other treaty, convention or internatinal agreement in question.
6. Nothing in the present Convention shall prejudice the codification and development of the law of the sea by the United Nations Conference on the Law of the Sea convened pursuant to Resolution 2750 C (XXV) or the General Assembly of the United Nations not the present or future claims nad legal views of any State concerning the law of the sea and the nature and extent of coastal and flag State jurisdicition.
Article XV
AMENDMENTS TO APPENDICES I AND II
1. The following provisions shall apply in relation to amendments to Appendices I and II at meetings of the Conference of the Parties:
(a) Any Party may propose an amendment to Appendix I or II for consideration at the next meeting. The next of the proposed amendment shall be communicated to the Secretariat at least 150 days before the meeting. The Secretariat shall consult the other Parties and interested bodies on the amendment in accordance with the provisions of sub-paragraphs (b) and (c) of paragraph 2 of this Article and shall comunicate the response to all Parties not later than 30 days before the meeting.
(b) Amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes »Parties present and voting« means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment.
(c) Amendments adopted at a meating shall enter into force 90 days after that meeting for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.
2. The following provisions shall apply in relation to amendments to Appendices I and II between meetings of the Conference of the Parties:
(a) Any Party may propose an amendment to Appendix I or II for consideration between meetings by the postal procedures set forth in this paragraph.
(b) For marine species, the Secretariat shall, upon receiving the text of the proposed amendment, immediately communicate it to the Parties. It shall also consult inter-governmental bodies having a function in relation to those species especially with a view to obtaining scientific data these bodies may be able to provide and to ensuring co-ordination with any conservation measures enforced by such bodies. The Secretariat shall communicate the views expressed and data provided by these bodies and its own findings and recommendations to the Parties as soon as possible.
(c) For species other than marine species, the Secretaria: shall, upon receiving the text of the proposed amendment, immediately communicate it to the Parties, and, as soon as possible thereafter, its own recommendations.
(d) Any Party may, within 60 days of the date on which the Secretariat communicated its recommendations to the Parties under sub-paragraph (b) or (c) of this paragraph, transmit to the Secretariat any comments on the proposed amendment together with any relevant scientific data and information.
(e) The Secretariat shall communicate the replies received together with its own recommendations to the Parties as soon as possible.
(f) If no objection to the proposed amendment is received by the Secretariat within 30 days of the date the replies and recommendations were communicated under the provisions of sub-paragraph (e) of this paragrah, the amendment shall enter into force 90 days later for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.
(g) If an objection by any Party is received by the Secretariat, the proposed amendment shall be submitted to a postal vote in accordane with the provisions of sub-paragraphs (h), (i) and (j) of this paragraph.
(h) The Secretariat shall notify the Parties that notification ob objection has been received.
(i) Unless the Secretariat receives the votes for, against or in abstenation from at least one-half of the Parties within 60 days of the date of notifiction under sub-paragraph (h) of this paragraph, the proposed amendment shall be referred to the next meeting of the Conference for further consideration.
(j) Provided that votes are received from one-half of the Parties, the amendment shall be adopted by a two-thirds majority of Parties casting an affirmative or negative vote.
(k) The Secretariat shall notify all Parties of the result of the vote.
(l) If the proposed amendment is adopted it shall enter into force 90 days after the date of the notification by the Secretariat of its acceptance for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.
3. During the period of 90 days provided for by sub-paragraph (c) of paragraph 1 or sub-paragraph (I) or paragraph 2 of this Article any Party may be notification in writing to the Depositary Government make a reservation with respect to the amendment. Until such reservation is withdrawn the Party shall be treated as a State not a Party to the present Convention with respect to trade in the species concemed.
Article XVI
APPENDIX III AND AMENDMENTS THERETO
1. Any Party may at any time submit to the Secretariat a list of species which it identifies as being subject to regulation within its jurisdiction for the purpose mentioned in paragraph 3 of Article II. Appendix III shall include the names of the Parties submitting the species for inclusion therein, the scientific names of the species so submitted, and any parts of derivatives of the animals or plants concerned that are specified in relation to the species for the purposes of sub-paragraph (b) of Article I.
2. Each list submitted under the provisions of paragraph 1 of this Article shall be cummunicated to the Parties by the Secretariat as soon as possible after receiving it. The list shall take effect as part of Appendix III 90 days after the date of such communication. At any time after the communication of such list, any Party may by notification in writing to the Depositary Government enter a reservation with respect to any species or any parts or derivatives, and until such reservation is withdrawn, the State shall be treated as a State not a Party to the present Convention with respect to trade in the species or part or derivative concerned.
3. A Party which has submitted a species for inclusion in Appendix III may withdraw it at any time by notification to the Secretariat which shall communicate the withdrawal to all Parties. The withdrawal shall take effect 30 days after the date of such communication.
4. Any Party submitting a list under the provisions of paragraph 1 of this Article shall submit to the Secretariat a copy of all domestic laws and regulations applicable to the protection of such species, together with any interpretations which the Party may deem appropriate or the Secretariat may request. The Party shall, for as long as the species in question is included in Appendix III, submit any amendments of such laws and regulations or any interpretations as they are adopted.
Article XVII
AMENDMENT OF THE CONVENTION
1. An extraordinary meeting of the Conference of the Parties shall be convened by the Secretariat on the written request of at least one-third of the Parties to consider and adopt amendments to the present Convention. Such amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes »Parties present and voting« means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment.
2. The text of any proposed amendment shall be communicated by the Secretariat to all Parties at least 90 days before the meeting.
3. An amandment shall enter into force for the Parties which have accepted it 60 days after two-thirds of the Parties have deposited an instrument of acceptance of the amendment with the Depositary Government. Thereafter, the amendment shall enter into force for any other Party 60 days after that Party deposits its instrument of acceptance of the amendment.
Article XVIII
RESOLUTION OF DISPUTES
1. Any dispute which may arise between two or more Parties with respect to the interpretation or application of the provisions of the present Convention shall be subject to negotiation between the Parties involved in the dispute.
2. It the dispute can not be resolved in accordance with paragraph 1 of this Article, the Parties may, by mutual consent, submit the dispute to arbitration, in particular that of the Permanent Court of Arbitration at The Hague, and the Parties submitting the dispute shall be bound by the arbitral decision.
Article XIX
SIGNATURE
The present Convention shall be open for signature at Washington until 30th April 1973 and thereafter at Berne until 31st December 1974.
Article XX
RATIFICATION, ACCEPTANCE, APPROVAL
The present Convention shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the Swiss Confederation which shall be the Depositary Government.
Article XXI
ACCESSION
The present Convention shall be open indefinitely for accession. Instruments of accession shall be deposited with the Depositary Government.
Article XXII
ENTRY INTO FORCE
1. The present Convention shall enter info force 90 days after the date of deposit of the tenth instrument of ratification, acceptance, approval or accession, with the Depositary Government.
2. For each State which ratifies, accepts or approves the present Convention or accedes thereto after the deposit of the tenth instrument of ratification, acceptance, approval or accession, the present Convention shall enter into force 90 days after the deposit by such State of its instrument of ratification, acceptance, approval or accession.
Article XXIII
RESERVATIONS
1. The provisions of the present Convention shall not be subject to general reservations. Specific reservations may be entered in accordance with the provisions of this Article and Articles XV and XVI.
2. Any State may, on depositing its instrumental of ratification, acceptance, approval or accession, enter a specific reservation with regard to:
(a) any species included in Appendix I, II or III; or
(b) any parts or derivatives specified in relation to a species included in Appendix III.
3. Until a Party withdraws its reservation entered under the provisions of this Article, it shall be treated as a State not a Party to the present Convention with respect to trade in the particular species or parts or derivatives specified in such reservation.
Article XXIV
DENUNCIATION
Any Party may denounce the present Convention by written notification to the Depositary Government at any time. The denunciation shall take effect twelve months after the Depositary Government has received the notification.
Article XXV
DEPOSITARY
1. The original of the present Convention, in the Chinese, English, French, Russian and Spanish languages, each version being equally authentic, shall be deposited with the Depositary Government, which shall transmit certified copies thereof to all States that have signed it or deposited instruments of accession to it.
2. The Depositary Government shall inform all signatory and acceding States and the Secretariat of signatures, deposit of instruments of ratification, acceptance, approval or accession, entry into force of the present Convention, amendments thereto, entry and withdrawal of reservations and notifications of denunciation.
3. As soon as the present Convention enters into force, a certified copy thereof shall be transmitted by the Depositary Government to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.
IN WITNESS WHERE OF the undersigned Plenipotentiaries, being duly authorized to that effect, have signed the present Convention.

ARTICLE XXI OF THE CONVENTION

Article XXI
ACCESSION
The present Convention shall be open indefinitely for accession. Instruments of accession shall be deposited with the Depositary Government.
1. This Convention shall be open indefinitely for accession by regional economic integration organisations constituted by sovereign States which have competence in respect of the negotiation, conclusion and implementation of international agreements in matters transferred to them by their Member States and covered by this Convention.
2. In their instruments of accession, such organisations shall declare the extent of their competence with respect to the matters governed by the Convention, these organisations shall also inform the Depositary of any substantial modification in the extent of their competence. Notifications by regional economic integration organisations concerning their competence with respect to matters governed by this Convention and modifications thereto shall be distributed to the Parties by the Depositary.
3. In matters with their competence, such regional economic integration organisations shall exercise the rights and fulfil the obligations which this Convention attributes to their Member States, which are Parties to the Convention. In such cases the Member States of the organisations shall not be entitled to exercise such rights individually.
4. In the fields of their competence, regional economic integration organisations shall exercise their right to vote with a number of votes equal to the number of their Member States which are Parties to the Convention. Such organisations shall not exercise their right to vote if their Member States exercise theirs, and vice versa.
5. Any reference to »Party« in the sense used in Article 1 (h) of this Convention, to »State«/»States« or to »State Party«/»States Parties« to the Conventions shall be construed as including a reference to any regional economic integration organisation having competence in respect of the negotiation, conclusion and application of international agreements in matters covered by this Convention.

°605 For the exclusive purpose of allowing international trade in live animals to appropriate and acceptable destinations and hunting trophies. All other specimens shall be deemed to be specimens of species included in Appendix I and the trade in them shall be regulated accordingly

13. As none of the species or higher taxa of FLORA included in Appendix I is annotated to the effect that its hybrids shall be treated in accordance with the provisions of Article III of the Convention, this means that artificially propagated hybrids produced from one or more of these species or taxa may be traded with a certificate of artificial propagation, and that seeds and pollen (including pollinia), cut flowers, seedling or tissue cultures obtained in vitro, in solid or liquid media, transported in sterile containers of these hybrids are not subject to the provisions of the Convention.

1. Obilježi rubriku odgovarajućeg tipa isprave (izvozno dopuštenje, uvjerenje za ponovni izvoz, uvozno dopuštenje ili drugo). Ako je obilježena rubrika »drugo«, potrebno je naznačiti tip isprave. Originalni broj je jedinstveni broj kojega ovlaštena uprava dodjeljuje svakoj ispravi.
2. Za izvozna dopuštenja i uvjerenja za ponovni izvoz, datum istjecanja isprave ne može biti duži od šest mjeseci nakon datuma izdavanja (za uvozna dopuštenja jedna godina).
3. Ispuni ime i adresu uvoznika.
3a. Mora pisati puno ime zemlje.
4. Ispuni ime i adresu izvoznika/ponovnog izvoznika. Nužno je navesti ime zemlje. Bez potpisa podnositelja zahtjeva isprava je nevažeća.
5. Posebni uvjeti mogu se odnositi na nacionalno zakonodavstvo ili na posebne uvjete koje traži ovlaštena uprava u svezi s pošiljkom.
5a. Upotrebljavaju se slijedeće oznake: T - za trgovinu, Z - za zoološke vrtove, G - za botaničke vrtove, Q - za cirkuse i putujuće izložbe, S - za znanstvene svrhe, H - lovački trofeji, P - osobno vlasništvo, M - za biomedicinska istraživanja, E - za obrazovanje, N - za ponovno unošenje ili unošenje u prirodu, B - za razmnožavanje u zatočeništvu ili umjetni uzgoj.
5b. Navedi broj (uključujući ISO kôd zemlje) sigurnosne marke nalijepljene u 13. rubrici.
6. Ime, adresa i zemlja ovlaštene uprave trebaju već biti tiskani na obrascu.
7-8. Navedi znanstveno ime (rod i vrstu, tamo gdje je prikladno i podvrstu) životinje ili biljke onako kako se navode u dodacima Konvencije ili na odgovarajućim popisima koje je donijela Konferencija stranaka, te ime biljke ili životinje koje se koristi u zemlji koja izdaje dopuštenje.
9. Opiši što je moguće preciznije, primjerke u pošiljci (žive životinje, kože, novčanici, cipele i dr.). Ako je primjerak obilježen (markica, prsten i dr.), bez obzira zahtijeva li to Rezolucija Konferencije stranaka (primjeci iz uzgojnoga programa, primjerci podložni kvotama koje odobrava Konferencija stranaka, primjerci vrsta iz Dodatka I uzgojeni u komercijalne svrhe. i dr.) navedi broj i tip oznake. Ako je moguće, navedi spol i starost žive životinje.
10. Upiši broj dodatka Konvencije (I, II ili III) na kojemu se nalazi predmetna vrsta. Za porijeklo se koriste slijedeće oznake:
W - primjerci uzeti iz prirode
R - primjerci iz posebnog uzgojnog programa
D - Vrste iz Dodatka I uzgojene u komercijalne svrhe, kao i njihovi dijelovi i derivati, koji se izvoze pod uvjetima iz članka VII. stavka 4. Konvencije.
A - Biljke umjetno razmnožene u skladu s Rezolucijom Konf. 9. (rev.) stavak a), kao i njihovi dijelovi i derivati, koji se izvoze pod uvjetima iz članka VII. stavka 5. Konvencije (primjer vrsta iz Dodatka I koji su umjetno uzgojeni za nekomercijalne svrhe, te primjerci vrsta iz dodataka II i III).
C - Životinje uzgojene u zatočeništvu u skladu s Rezolucijom Konf. 10.16, kao i njihovi dijelovi i derivati, koji se izvoze pod uvjetima iz članka VII. stavka 5. Konvencije (primjerci vrsta Dodatka I koji su uzgojeni u zatočeništvu za nekomercijalne svrhe, te primjerci vrsta iz dodataka II i III).

I - zaplijenjeni ili oduzeti primjerci.
11. Navedi ukupan broj primjeraka ili, ukoliko to nije moguće količinu, te označi korištenu mjernu jedinicu (npr. težina u kilogramima). Ne služi se općim izrazima kao »jedna kutija« »jedna serija«.
11a. Navedi ukupan broj primjeraka izvezenih u tekućoj kalendarskoj godini (uključujući i one na koje se odnosi predmetno dopuštenje) i važeću godišnju kvotu za navedenu vrstu (npr. 500/1000). Ovo je potrebno u slučaju nacionalnih kvota kao i onih koje utvrdi Konferencija stranaka.
12. Zemlja porijekla je zemlja u kojoj su primjerci uzeti iz prirode ili uzgojeni. Navedi broj izvoznoga dopuštenja te zemlje, datum izdavanja. Ukoliko cijela ili dio informacije nije poznat to je potrebno navesti u 5. rubrici. Ovu rubriku je potrebno popuniti samo u slučaju ponovnog izvoza.
12a. Zemlja posljednjega ponovnog izvoza je zemlja iz koje su primjerci bili ponovno izvezeni prije nego su ušli u zemlju gdje se sada izdaje isprava. Upiši broj uvjerenja ponovnog izvoza i da njegova izdavanja. Ukoliko cijela ili dio informacije nije poznato, to treba navesti u 5. rubrici. Ovu rubriku je potrebno popuniti samo u slučaju ponovnog izvoza primjeraka koji su već ranije bili ponovno izvezeni.
13. Popunjava službenik koji izdaje dopuštenje. Ime i titula službenika moraju biti potpuni. U ovoj rubrici treba nalijepiti sigurnosnu marku te je poništiti potpisom službenika i službenim pečatom. Pečat, potpis i broj sigurnosne marke moraju biti jasno čitljivi.
14. Popunjava službenik koji pregledava pošiljku u vrijeme izvoza ili ponovnog izvoza. Upiši količinu primjeraka koji se stvarno izvoze ili ponovno izvoze. Precrtaj nepopunjene rubrike.
15. Upiši broj tovarnog lista ukoliko korišteni način transporta zahtijeva takvu ispravu.
Ova isprava mora biti ispunjena na jednom od tri radna jezika Konvencije (engleski, francuski i španjolski) ili mora sadržavati puni prijevod jedan od ova tri jezika. Izvezeni i ponovno izvezeni primjerci ne smiju biti navedeni u istoj ispravi, ukoliko nije izričito navedeno koji se primjerci izvoze, a koji ponovno izvoze.

1. Tick the square which corresponds to the type of document issued (export permit, re-export, certificate, import permit or other). If the box »other« has been ticked, the type of document must be indicated. The original number is a unique number allocated to each document by the Management Authority.
2. For export permits and re-export certificates, the date of expiry of the document may not be more than six months after the date of issuance (one year for import permits).
3. Complete name and address of the importer.
3a. The name of the country must be written in full.
4. Complete name and address of the exporter/re-exporter. The name of the country must be stated. The absence of the signature of the applicant renders the permit or certificate invalid.
5. Special conditions may refer to national legislation or special conditions placed on the shipment by the issuing Management Authority. This block can also be used to justify the omission of certain information.
5a. The following codes should be used: T for commercial, Z for zoos, G for botanical gardens, Q for circuses and travelling exhibitions, S for scientific purposes, H for hunting trophies, P for personal, M for biomedical research, E for education, N for reintroduction or introduction into the wild, and B for breeding in captivity or artificial propagation.
5b. Indicate the number (including the countryžs ISO code) of the security stamp affixed in block 13.
6. The name, address and country of the issuing Management Authority should already be printed on the form.
7-8. Indicate the scientific name (genus and species, where appropriate subspecies) of the animal or plant as it appears in the Convention appendices or the reference lists approved by the Conference of the Parties, and the common name of the animal or plant as known in the country issuing the permit.
9. Describe, as precisely as possible, the specimens entering trade (live animals, skins, flanks, wallets, shoes, etc.). If a specimen is marked (tags, identifying marks, rings, etc.), whether or not this is required by a Resolution of the Conference of the Parties (specimens originating in a ranching operation, specimens subject to quotas approved by the Conference of the Parties, specimens of Appendix-I species bred in captivity for commercial purposes, etc.), indicate the number and type of mark. The sex and age of the live animals should be recorded, if possible.
10. Enter the number of the appendix of the Convention (I, II or III) in which the species is listed.

11. Indicate the total number of specimens or, if this is not possible, the quantity, and specify the unit of measurement used (for example the weight in kilograms). Do not use general terms such as »one case« or »one batch«.
11a. Indicate the total number of specimens exported in the current calendar year (including those covered by the present permit) and the current annual quota for the species concerned (for example 500/1000). This should be done for the national quotas as well as for those determined by the Conference of the Parties.
12. The country of origin is the country in which the specimens were taken from the wild, bred in captivity or artificially propagated. Indicate the number of the export permit of the country and the date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-exports.
12a. The country of last re-export is the country from which the specimens were re-exported before entering the country in which the present document is issued. Enter the number of the re-export certificate of the country of last re-export and its date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-export of specimens previously re-exported.
13. To be completed by the official who issues the permit. The name of the official (and his title) must be written in full. The security stamp must be affixed in this block and must be cancelled by the signature of the issuing official and a stamp or seal. The seal, signature and security-stamp number should be clearly legible.
14. To be completed by the official who inspects the shipment at the time of export or re-export. Enter the quantities of specimens actually exported or re-exported. Strike out the unused blocks.
15. Enter the number of the bill of lading or air way-bill if the method of transport used requires the use of such a document.
The document must be written in one of the three working languages of the Convention (English, French and Spanish) or must include a full translation into one of these three languages. Exported and re-exported specimens should not appear on the same document unless it is clearly indicated which specimens are being exported and which re-exported.

Članak 3.
Za provedbu ovoga Zakona zadužuje se središnje tijelo državne uprave nadležno za zaštitu prirode. Isto tijelo se imenuje ovlaštenom upravom u smislu članka IX. Konvencije.
Članak 4.
Znanstvenim tijelima u smislu članka IX. Konvencije imenuju se Prirodoslovno-matematički fakultet u Zagrebu i Zavod za ornitologiju Hrvatske akademije znanosti i umjetnosti u Zagrebu.
Članak 5.
Ovlašćuje se Vlada Republike Hrvatske za donošenje propisa za izvršenje ovoga Zakona.
Članak 6.
Ovaj Zakon stupa na snagu osmoga dana od objave u »Narodnim novinama«.
