Članak 1.
Objavljuju se Izmjene i dopune Dvostranog sporazuma o projektu između Vlade Republike Hrvatske i Europske komisije vezano uz sufinanciranje velikog projekta »Županijski centar za gospodarenje otpadom KAŠTIJUN« CCI br.: 2008HR16IPR001 u okviru Instrumenta pretpristupne pomoći (IPA) IPA Komponenta III – Regionalni razvoj Operativni program »Zaštita okoliša« CCI br.: 2007HR16IPO003, potpisane u Bruxellesu, 8. siječnja 2013. godine i u Zagrebu, 11. ožujka 2013. godine, u izvorniku na engleskom jeziku.

AMENDING BILATERAL PROJECT AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF CROATIA AND THE EUROPEAN COMMISION CONCERNING THE CO-FINANCING OF THE MAJOR PROJECT «COUNTY WASTE MANAGEMENT CENTRE KAŠTIJUN» CCI NO: 2008HR16IPR001 UNDER THE INSTRUMENT FOR PRE-ACCESSION ASSISTANCE (IPA) IPA COMPONENT III – REGIONAL DEVELOPMENT OPERATIONAL PROGRAMME «ENVIRONMENTAL» CCI NO: 2007HR16IPO003

Having regard to Article 56 of the Financing Agreement,
Having regard to Article 9 of the Bilateral Project Agreement between the Government of the Republic of Croatia and the European Commission,
Whereas:
(1) The Treaty of Lisbon entered into force on 1 December 2009.
(2) The Commission Regulation (EC) No 718/2007 of 12 June 2007 implementing Coucil Regulation (EC) No 1085/2006 establishing an instrument for pre-accession assistance (IPA)[1] was last amended by Regulation (EU) No 813/2012 of 12 September 2012[2].
(3) On 29 November 2007, the Commission adopted a Decision C(2007)5734 approving the multi-annual operational programme «Environmental» for EU assistance from the Instrument of Pre-Accession Assistance for the Regional Development component in the Republic of Croatia. On 22 June 2010 the Commission adopted Decision C(2010) 3775, and on 23 October 2012 the Decision C(2012)7401 modifying the programme.
(4) By Decision C(2009)2584 of 8 April 2009, as amended by Decision C(2011) 1769 of 21 March 2011, the Commission granted an assistance to the major project «County Waste Management Centre KAŠTIJUN».
(5) A Bilateral Project Agreement, regarding the major project «County Waste Management Centre KAŠTIJUN» forming part of the multi-annual operational programme «Environmental» 2007-2009 was signed on 29 June 2009 between the Government of the Republic of Croatia and the European Commission as amended on 11 April 2011.
(6) On 20 August 2012, the national authorities submitted a request for amending this Major Project in which they requested a change to the maximum IPA contribution due to the revised funding gap calculation and a minor change in the composition of the supply equipment.
(7) Decision C(2009) 2584 of 8 April 2009 approving the major project was modified by Decision C(2012) 9481 of 17/12/2012 in order to take the request changes into account.
(8) The Bilateral Agreement should therefore be modified accordingly.
HAS AGREED AS FOLLOWS:
Article 1
The Bilateral Project Agreement signed on 29 June 2009 between the Government of the Republic of Croatia and the European Commission is amended as follows:
1. Article 2 is amended as follows:
(a) Paragraph 1 is replaced by the following:
«1. The eligible expenditure calculated in accordance with Article 150 of Regulation (EC) No 718/2007 is set at EUR 29 465 875.»;
(b) Paragraph 2 is replaced by the following:
«2. The co-financing rate for the priority axis 1- Developing Waste Management Infrastructure of the operational programme «Environmental» applies to the project. The maximum IPA contribution to the project is set at EUR 25 045 994.»
2. The Annex is replaced by the Annex to this Agreement.
Article 2
In accordance with Article 9(2) of the Bilateral Project Agreement, expenditure relating to a physical object introduced by the modification of a Commission Decision is eligible from the date of approval of the modification by the Commission.
Article 3
This Agreement is drawn up in duplicate in the English language.

4. PROJECT DESCRIPTION
A.4.1. General description of the physical object of the project
The project concerns the establishment of an integrated waste management centre in the County of Istria. It comprises of the construction of a landfill, a mechanical & biological treatment (MBT) plant, the construction of six transfer stations, the development of recycling activities and the closure and rehabilitation of the existing landfills and dumpsites. Where appropriate, the extension of the landfill cells will take place.
The construction of two landfill cells with accompanied facilities and the MBT plant will be co-financed from the Instrument for Pre-Accession Assistance (IPA). The realisation of the transfer stations and the closure and rehabilitation of the existing landfills and dumpsites will be financed from national funds. The construction of the plant for the production of electricity from biogas and the potential extension of the landfill will be funded from the gate fee established at the entrance of the waste management centre.
The project will be constructed adjacent to the existing Kastijun landfill, 5 km south from the city of Pula, in the County of Istria with a population of 206.350 inhabitants. It consists of units of local self-governments, namely 10 towns and 31 municipalities.
The current situation regarding waste management at the County cannot be described as an integrated one as the existing seven official landfills are inadequately equipped; sanitary-technical conditions are unsatisfactory; there is no control and treatment of landfill gases; fire access roads are missing; exact data regarding quantities of disposed waste are unavailable; there are no significant measures for the reduction of the waste produced nor is there any waste treatment before the disposal of waste.
The project as a whole comprises of four stages, namely a) preliminary activities such as investigation works, geotechnical-geological investigations, topographic surveys, permits and technical designs which are financed from national funds, b) the construction of two landfill cells with accompanied facilities and a mechanical and biological treatment plant to be co funded from IPA, c) the construction of six transfer stations to be financed by national funds and d) the construction of a power plant and the potential enlargement of the landfill.
The realisation of all stages of the project will be essential to ensure an integrated solid waste management system fully operational to serve the objectives for which is approved and ensue also its financial viability and sustainability. Simultaneously, the introduction and development of recycling measures at County level should be adopted and put in place.
A.4.2. Technical description of the infrastructure investment
The following items of works are co-financed from IPA:
A. Construction of a landfill & a mechanical and biological treatment plant
a.1 The construction of landfill comprises of two cells. The first cell concerns a bio-reactive landfill cell for municipal waste with a capacity of 201.700 m³ of waste to be exhausted in the period 2014-2017. The second one relates to the construction of a cell for industrial non-hazardous waste with a capacity of 263.095 m³ for the period 2014-2022. Main works include the construction of the landfill area and its corresponding facilities, namely: terrain preparation, construction of internal roads, construction of an entrance and administrative building and of a transport and maintenance centre, construction of a recycling yards, construction of a waste water treatment plant, waste water and water supply networks, a leachate collection system, a degassing system as well as the construction of a facility for gas treatment (gas flare) as well as all other associated infrastructure described in project application.
a.2 The construction of a mechanical & biological treatment plant with accompanying equipment of bio-drying type with a capacity of 90 000 t where biological & mechanical techniques of municipal waste treatment are combined in order to produce Solid Recovered Fuel (SRF), stabilise waste and reduce the volume of waste for disposal.
B. Equipment
It concerns the purchase of the landfill and waste management transport equipment. The exact number and precise nature of this equipment is described in the updated project application.
C. Technical Assistance
It concerns technical assistance to the Kaštijun Ltd to facilitate the project implementation. Amongst others, the activities concern actions to provide assistance to the end recipient for the establishment, construction and operation of a waste management system, educate and train the end recipient in the management of waste issues.
D. Publicity Measures
It relates to publicity actions including the design and distribution of promotional brochures and leaflets; production of newsletters and print of advertisements, recording of commercials for radio and TV stations; the organisation and delivery of seminars, trainings and workshops.
E. Supervision
It concerns the provision of supervisory services through the recruitment of an Engineer in accordance with the FIDIC Conditions of Contract.

5. OBJECTIVES
The overall project objective is to introduce an integrated waste management system in order to tackle in an efficient way the waste management at the County of Istria. With the development of modern waste management infrastructure facilities, the needs of about 206 000 inhabitants will be served. It will tackle in an efficient way the waste collection, its treatment and disposal. Waste disposal to landfills will be reduced, energy recovery will be introduced, recycling yards will be installed and the principles of sustainable development will be developed. It will also contribute in improving the protection of the environment and human health.
The following are planned to be realised:
– Construction of a landfill with a bio-reactive cell and a cell for non-hazardous industrial waste. The landfill gas will be used for the production of electricity. To this end, a power plant will be constructed as from 2014 onwards,
– Mechanical-biological treatment of waste before final disposal and extraction of solid recovered fuel (SRF) as alternative fuel and metals,
– Reduction of the share of biodegradable waste in the municipal waste deposited on landfill,
– Purchase of transportation system to ensure transfer of waste from the transfer stations to the waste management centre,
– Introduction of recycling, and reuse of waste,
– Construction of six (6) transfer stations,
– Closure and rehabilitation of the existing landfills and dumpsites.
6. INDICATIVE PHYSICAL AND/OR PERFORMANCE INDICATORS
The indicators shown below might be rectified when deemed necessary, in particular upon the finalisation of the contracting. Should it be the case, confirmation of the final value of the indicators will be by exchange of letters between the Operating Structure and the Commission services.

– Waste Framework Directive 2006/12/EC,
– Landfill Directive 1999/31/EC,
– Sewage Sludge Directive 86/278/EEC,
– Directive 2002/96/EC on waste electrical and electronic equipment (WEEE),
– Directive 86/278/EEC on the protection of the environment, and in particular of the soil when sewage sludge is used for agricultural purposes.
– Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment.

8. SUMMARY OF THE MAIN RESULTS OF THE ECONOMIC AND SOCIAL COST-BENEFIT ANALYSIS
According to the Cost Benefit Analysis (CBA) carried out by the Croatian Authorities, the principal indicators of the economic and social cost benefit analysis are as follows:
– The estimated ENPV for the project is EUR 29 771 274 and the social discount rate (real) used is 5,5%;
– The estimated Benefit/Cost ratio is 1,46
– The estimated ERR = 16,86%.
9. SUMMARY OF THE FINANCIAL ANALYSIS
Based on the information provided in the application form:
– The FNPV with IPA funding for the project is estimated at EUR 3 553 620.
– The FRR is estimated at 6,73%.
– The eligible expenditure (funding gap rate of 84,02%) as calculated in accordance with Articles 17 and 19 of the Financing Agreement is set at EUR 29 465 875.
– The IPA contribution is set at EUR 25 045 994.
10. POLLUTER PAYS PRINCIPLE
The introduction of the integrated waste management anticipates the introduction of a tariff model according to the quantities of municipal waste (t) produced. To that end, a gate fee will be introduced. A price per ton for each type of waste delivered to the waste management centre – be it municipal, non-hazardous industrial; construction or demolition waste – will be calculated and applied. Each category of waste generator will pay a gate fee that reflects the underlined costs net of revenue for treating and disposing of the waste received. The users will be charged different gate fees according to the waste type and proportionally to the pollution generated by the amount of waste produced as well as according to the ability to pay.
In particular, the gate fee should cover the following costs:
– All operating and maintenance cost of the entire County Waste Management Centre (CWMC);
– Costs of waste transport between the Transfer Stations and the CWMC,
– Transportation of SRF to the cement industry or alternative,
– Cost for the construction of an electricity power plant,
– Cost of post cell-closure monitoring,
– Reservations to construct new landfill cells, and replacement of vehicles and other equipment.
11. FINANCIAL SUSTAINABILITY AND AFFORDABILITY
The financial analysis carried out by the Croatian Authorities shows that the project over its life time is financially sustainable.
As regards affordability, following the completion of the project and functioning of the waste management centre, the average affordability rate for the households, depending on their location, will be between 0,83% and 1% of the average income and from 2,05% to 2,47% of the minimal income.
12. OPERATION AND MAINTENANCE
Following the completion of the project by the Implementing Body, the project will be handed over to the end recipient of assistance i.e. Kaštijun Ltd. The Kaštijun Ltd is a fully publicly owned company which is founded by the City of Pula and County of Istria in order to manage the County Waste Management Centre.
Following the handover of the project, the Management of the Kaštijun Ltd will be responsible for the operation and maintenance of the waste management centre. It will coordinate the overall activities of the company, provide the administrative and operational services necessary for the smooth function of the waste management centre and manage contracting and business issues with the local self-government units. It will define the pricing policy to apply which must be implemented before the operation of the management waste centre.
The new organisational and managerial structure of the company with the necessary and skilled staffing should be established before the operation of the waste management centre.
13. SUMMARY OF THE MAIN FINDINGS OF THE ENVIRONMENTAL IMPACT ASSESSEMENT
The Environmental Impact Assessment (EIA) was carried out and the environmental impact study was submitted for evaluation to the Ministry of Environmental Protection, Physical Planning and Construction in July 2007. The Ministry issued the Development Consent on 12 August 2008. An amended Development Consent was issued on 14 August 2009. The decision of the Ministry to consider the proposed intervention concerning the construction of the waste management centre is accompanied by environmental mitigation measures including a monitoring programme.

15. INVOLVEMENT OF INTERNATIONAL FINANCIAL INSTITUTIONS (IFIS)
A loan from the European Investment Bank is secured through the Ministry of Finance. It will be used to match the national funding part of the MBT component.
19. PUBLICITY MEASURES
The following publicity measures are envisaged:
– Production of internet page, preparation and distribution of brochures and leaflets, articles for publication in newspapers, recording and broadcasting of TV and radio commercials,
– Organisation of trainings and workshops for stakeholders concerned,
– Training provided to End Recipient employees in public relations with an accent on waste management issues & organization of press conferences,
– A billboard that will be erected on construction site during works in line with EC Visibility Guidelines,
– Following completion of works, a commemorative plaque will replace the billboard on constructed infrastructure in line with the requirements of the EC Visibility Guidelines.

Uzimajući u obzir članak 56. Sporazuma o financiranju,
Uzimajući u obzir članak 9. Dvostranog sporazuma o projektu između Vlade Republike Hrvatske i Europske komisije,
Budući da:
(1) je Lisabonski ugovor stupio na snagu 1. prosinca 2009.
(2) je Uredba Komisije (EZ) br. 718/2007 od 12. lipnja 2007. kojom se provodi Uredba Vijeća (EZ) br. 1085/2006 kojom se uspostavlja Instrument pretpristupne pomoći (IPA)[1] izmijenjena i dopunjena Uredbom (EU) br. 813/2012 od 12 rujna 2012[2].
(3) je dana 29. studenoga 2007. Komisija usvojila Odluku C(2007)5734 kojom se odobrava višegodišnji operativni program »Zaštita okoliša« za EU pomoć u okviru Instrumenta pretpristupne pomoći za komponentu Regionalni razvoj u Republici Hrvatskoj. Dana 22. lipnja 2010. Komisija je usvojila Odluku C(2010)3775, a dana 23. listopada 2012. Odluku C(2012) 7401 o izmjeni programa.
(4) je Odlukom C(2009)2584 od 8. travnja 2009. koja je izmijenjena i dopunjena Odlukom C(2011) 1769 od 21. ožujka 2011., Komisija odobrila pomoć za veliki projekt »Županijski centar za gospodarenje otpadom KAŠTIJUN«.

(6) su dana 20. kolovoza 2012. nacionalne vlasti podnijele zahtjev za izmjenom i dopunom ovog velikog projekta, u kojem su zatražile izmjenu maksimalnog doprinosa iz IPA-e uslijed revidiranog izračuna stope manjka financiranja i manje izmjene u stavkama za nabavu opreme.
(7) je Odluka C(2009) 2584 od 8. travnja 2009. kojom se odobrava veliki projekt izmijenjena i dopunjena Odlukom C(2012) 9481 od 17. prosinca 2012., kako bi se uzele u obzir zatražene promjene.
(8) bi Dvostrani sporazum o projektu stoga trebalo odgovarajuće izmijeniti.
SPORAZUMJELE SU SE KAKO SLIJEDI:
Članak 1.
Dvostrani sporazum o projektu potpisan 29. lipnja 2009. između Vlade Republike Hrvatske i Europske komisije izmijenjen je i dopunjen kako slijedi:
1. Članak 2. izmijenjen je i dopunjen kako slijedi:
(a) Stavak 1. zamjenjuje se sljedećim:
»1. Prihvatljivi troškovi izračunati u skladu s člankom 150. Uredbe (EZ) 718/2007 iznose EUR 29.465.875.»;
(b) Stavak 2. zamjenjuje se sljedećim:
»2. Na projekt se primjenjuje stopa sufinanciranja za prioritetnu os 1 – Razvoj infrastrukture za gospodarenje otpadom Operativnog programa »Zaštita okoliša«. Najveći mogući IPA doprinos projektu iznosi EUR 25.045.994«.

Članak 2.
U skladu s člankom 9(2) Dvostranog sporazuma o projektu, izdaci vezani uz fizički objekt koji je uveden izmjenom Odluke Komisije postaju prihvatljivi od datuma odobrenja izmjene od strane Komisije.

Ovaj Sporazum sastavljen je u dva primjerka na engleskom jeziku.

4. OPIS PROJEKTA
A.4.1. Opći opis fizičkog objekta projekta
Projekt se odnosi na izgradnju centra za integrirano gospodarenje otpadom u Istarskoj županiji. Sastoji se od izgradnje odlagališta, postrojenja za mehaničku i biološku obradu otpada (MBO), izgradnju šest pretovarnih stanica, razvoja reciklažnih djelatnosti i zatvaranja i sanacije postojećih odlagališta i divljih odlagališta. Gdje je primjereno, proširit će se odlagališne plohe.
Izgradnja dviju odlagališnih ploha s pratećim objektima i MBO postrojenja sufinancirat će se sredstvima Instrumenta za pretpristupnu pomoć (IPA). Izgradnja pretovarnih stanica te zatvaranje i sanacija postojećih odlagališta i divljih odlagališta, financirat će se nacionalnim sredstvima. Izgradnja postrojenja za proizvodnju električne energije iz bioplina i moguće proširenje odlagališta financirat će iz ulazne pristojbe koja se naplaćuje na ulazu u centar za gospodarenje otpadom.
Projekt će biti izgrađen uz postojeće odlagalište Kaštijun, 5 km južno od grada Pule, u Istarskoj županiji koja ima 206.350 stanovnika i sastoji se od jedinica lokalne samouprave, i to od 10 gradova i 31 općine.
Sadašnja situacija u vezi gospodarenja otpadom u županiji ne može se opisati kao integrirani sustav, budući da je sadašnjih sedam službenih odlagališta neprimjereno opremljeno, sanitarno-tehnički uvjeti su nezadovoljavajući, nema nadzora i obrade odlagališnih plinova, nema protupožarnih cesta, nisu dostupni točni podaci o količinama odloženog otpada, nema značajnih mjera za smanjenje proizvedenog otpada niti se otpad obrađuje prije njegova odlaganja.
Cjelokupni projekt sastoji se od četiri faze, i to: a) preliminarne aktivnosti poput istražnih radova, geotehničko-geoloških istraživanja, topografskih izmjera, dozvola i tehničkih nacrta koji se financiraju iz nacionalnih sredstava, b) izgradnja dvije odlagališne plohe s pratećim objektima i uređaja za mehaničku i biološku obradu koji će se sufinancirati iz IPA programa, c) izgradnja šest pretovarnih stanica koje će se financirati nacionalnim sredstvima, i d) izgradnja elektrane i proširenje odlagališta u budućnosti.
Realizacija svih faza projekta bit će od temeljne važnosti za osiguravanje potpuno operativnog integriranog sustava gospodarenja krutim otpadom koji će služiti ciljevima za koje je odobren te također osigurati svoju financijsku izvedivost i održivost. Istovremeno bi trebalo usvojiti i provesti uvođenje i razvoj reciklažnih mjera na županijskoj razini.
A.4.2. Tehnički opis ulaganja u infrastrukturu
Sljedeće stavke radova sufinanciraju se iz IPA:
A. Izgradnja odlagališta i postrojenja za mehaničku i biološku obradu otpada
a.1 Izgradnja odlagališta obuhvaća dvije plohe. Prva ploha odnosi se na bioreaktivnu odlagališnu plohu za komunalni otpad kapaciteta 201.700 m³ otpada koja će se iscrpiti u razdoblju 2014.-2017. Druga ploha odnosi se na izgradnju plohe za neopasni proizvodni otpad kapaciteta 263.095 m³ za razdoblje 2014.-2022. Glavni radovi uključuju izgradnju prostora odlagališta i odgovarajućih objekata, poput pripreme terena, gradnje unutarnjih putova, izgradnje ulaza i upravne zgrade, izgradnje centra za prijevoz i održavanje, izgradnje reciklažnih dvorišta, izgradnje uređaja za pročišćavanje otpadnih voda, mreža za otpadnu vodu i vodoopskrbu, sustava sakupljanja procjedne vode i sustava otplinjavanja, kao i izgradnje uređaja za obradu plina (baklja), kao i druge povezane infrastrukture opisane u prijavi projekta.
a.2 Izgradnja postrojenja za mehaničku i biološku obradu s pratećom opremom za biosušenje kapaciteta 90 000 t, u kojem su kombinirane biološke i mehaničke tehnike obrade komunalnog otpada u cilju proizvodnje goriva iz otpada (GIO), stabilizacije otpada i smanjenja volumena otpada koji će se odlagati.
B. Oprema
Odnosi se na kupnju opreme za odlagalište i za prijevoz otpada. Točan broj stavki i vrste opreme opisani su u ažuriranoj prijavi projekta.
C. Tehnička pomoć
Odnosi se na tehničku pomoć za Kaštijun d.o.o. u cilju olakšavanja provedbe projekta. Aktivnosti se, među ostalim, odnose na pomoć krajnjem primatelju za uspostavu, izgradnju i rad sustava gospodarenja otpadom, obrazovanje i obuku krajnjeg primatelja za upravljanje pitanjima otpada.
D. Promidžbene mjere
Odnose se na promidžbeno djelovanje, uključujući izradu i distribuciju promidžbenih brošura i letaka; izradu biltena i tiskanje oglasa; snimanje reklama za radio i TV postaje; organizaciju i održavanje seminara, obuka i radionica.
E. Nadzor
Odnosi se na pružanje usluga nadzora putem angažiranja inženjera u skladu s FIDIC Uvjetima ugovaranja.
Cjeloviti tehnički opis infrastrukture koja će se sufinancirati, uključujući raščlambu troškova, opisan je u prijavi projekta.
5. CILJEVI
Opći cilj projekta je uvesti integrirani sustav gospodarenja otpadom koji ima za svrhu na učinkovit način riješiti gospodarenje otpadom u Istarskoj županiji. Razvojem modernih infrastrukturnih objekata za gospodarenje otpadom, uslugama će biti obuhvaćeno oko 206 000 stanovnika. Na učinkovit će način rješavati sakupljanje otpada, njegovu obradu i odlaganje. Smanjit će se odlaganje otpada na odlagalištima, uvest će se energetska oporaba, izgraditi reciklažna dvorišta te razviti načela održivog razvoja. Također, projekt će pridonijeti unapređenju zaštite okoliša i ljudskog zdravlja.
Planira se ostvariti sljedeće:
– Izgradnja odlagališta s bioreaktivnom plohom i plohom za neopasni proizvodni otpad. Odlagališni plin koristit će se za proizvodnju električne energije. U tu svrhu nakon 2014. godine izgradit će se elektrana,
– Mehaničko-biološka obrada otpada prije konačnog odlaganja uz izdvajanje krutog oporabljenog goriva (SRF) iz otpada kao zamjenskog goriva i metala,
– Smanjenje udjela biorazgradivog otpada u komunalnom otpadu zbrinutom na odlagalištu,
– Kupnja sustava za prijevoz u cilju osiguravanja prijevoza otpada iz pretovarnih stanica u centar za gospodarenje otpadom,
– Uvođenje recikliranja i ponovnog korištenja otpada,
– Izgradnja šest (6) pretovarnih stanica,
– Zatvaranje i sanacija postojećih odlagališta i divljih odlagališta.
6. INDIKATIVNI FIZIČKI POKAZATELJI I/ILI POKAZATELJI OSTVARENIH REZULTATA
Dolje navedeni pokazatelji mogu se ispraviti kada se to smatra nužnim, posebno nakon finalizacije ugovaranja. Ako to bude slučaj, potvrđivanje konačne vrijednosti pokazatelja uslijedit će razmjenom dopisa između Operativne strukture i službi Komisije.

8. sažetak glavnih rezultata ekonomske i socijalne analize troškova i koristi
Prema analizi troškova i koristi koju su provele hrvatske vlasti, glavni pokazatelji ekonomske i socijalne analize troškova i koristi su sljedeći:
– Procijenjena NSV za projekt je EUR 29.771.274, a primijenjena diskontna stopa je 5,5%;
– Procijenjeni omjer koristi/troškova je 1,46
– Procijenjena EISP = 16,86%.
9. SAŽETAK FINANCIJSKE ANALIZE
Na temelju informacija navedenih u obrascu prijave:
– FNSV s IPA financiranjem projekta procijenjena je na EUR 3.553.620.
– FISP procijenjena je na 6,73%.
– Prihvatljivi rashodi (stopa manjka financiranja od 84,02%) izračunati u skladu s člancima 17. i 19. Sporazuma o financiranju iznose EUR 29.465.875.
– IPA doprinos iznosi EUR 25.045.994.
10. NAČELO ONEČIŠĆIVAČ PLAĆA
Uvođenjem integriranog gospodarenja otpadom omogućit će se uvođenje tarifnog modela prema količinama proizvedenog komunalnog otpada (t). U tu će svrhu biti uvedena ulazna pristojba. Izračunavat će se i primjenjivati cijena po toni za svaku vrstu otpada koja se doprema u centar za gospodarenje otpadom – komunalni, neopasni proizvodni, građevinski otpad ili otpad od rušenja. Proizvođač svake vrste otpada plaćat će ulaznu pristojbu koja odražava temeljne troškove bez prihoda od obrade i zbrinjavanja zaprimljenog otpada. Korisnicima će se zaračunavati različite ulazne pristojbe prema vrsti otpada te proporcionalno onečišćenju kojeg izaziva količina proizvedenog otpada, kao i u skladu sa sposobnošću plaćanja.
Ulazna pristojba posebno bi trebala pokrivati sljedeće troškove:
− Sve troškove rada i održavanja cjelokupnog Županijskog centra za gospodarenje otpadom (ŽCGO);
− Troškove prijevoza otpada između pretovarnih stanica i ŽCGO-a,
− Prijevoz goriva iz otpada (GIO) do cementare ili alternative,
− Trošak izgradnje elektrane,
− Trošak praćenja stanja nakon zatvaranja plohe,
− Pričuve za izgradnju novih odlagališnih ploha i zamjenu vozila i druge opreme.
11. FINANCIJSKA ODRŽIVOST I DOSTUPNOST
Financijska analiza koju su provele hrvatske vlasti pokazuje da je projekt tijekom svog vijeka financijski održiv.
U pogledu dostupnosti, po završetku projekta i puštanja u rad centra za gospodarenje otpadom, prosječna stopa dostupnosti za kućanstva, ovisno o njihovoj lokaciji, bit će između 0,83% i 1% prosječnog dohotka te između 2,05% i 2,47% minimalnog dohotka.
12. RAD I ODRŽAVANJE
Po završetku projekta od strane Provedbenog tijela projekt će biti predan krajnjem primatelju pomoći, tj. Kaštijun d.o.o.. Kaštijun d.o.o. je tvrtka u potpunosti u javnom vlasništvu osnovana od Grada Pule i Istarske županije u svrhu upravljanja Županijskim centrom za gospodarenje otpadom.
Po predaji projekta, Uprava Kaštijuna d.o.o. bit će odgovorna za rad i održavanje centra za gospodarenje otpadom. Koordinirat će sveukupnu djelatnost tvrtke, pružat će administrativne i operativne usluge potrebne za nesmetani rad centra za gospodarenje otpadom, te će upravljati ugovaranjem i poslovnim pitanjima s jedinicama lokalne samouprave. Definirat će politiku cijena koja će se primjenjivati i koju treba provesti prije početka rada centra za gospodarenje otpadom.
Prije početka rada centra za gospodarenje otpadom treba uspostaviti novu organizacijsku i upravljačku strukturu tvrtke s potrebnim i stručnim osobljem.
13. SAŽETAK GLAVNIH NALAZA PROCJENE UTJECAJA NA OKOLIŠ
Provedena je procjena utjecaja na okoliš (PUO) i studija utjecaja na okoliš podnesena je na ocjenu Ministarstvu zaštitu okoliša, prostornog uređenja i graditeljstva, u srpnju 2007. Ministarstvo je 12. kolovoza 2008. izdalo Odluku o prihvatljivosti utjecaja zahvata na okoliš. Izmjena i dopuna Odluke o prihvatljivosti izdana je 14. kolovoza 2009. Odluka Ministarstva o razmatranju predloženog zahvata izgradnje centra za gospodarenje otpadom popraćena je mjerama ublažavanja, uključujući program praćenja.

15. UKLJUČENOST MEĐUNARODNIH FINANCIJSKIH INSTITUCIJA (MFI)
Putem Ministarstva financija osiguran je zajam od Europske investicijske banke. Koristit će se za nacionalno financiranje komponente projekta za MBO otpada.
16. PROMIDŽBENE MJERE
Predviđene su sljedeće promidžbene mjere:
– Izrada internetske stranice, izrada i distribucija brošura i letaka, članci za objavu u novinama, snimanje i emitiranje TV i radijskih promidžbenih poruka,
– Organizacija obuke i radionica za zainteresirane dionike,
– Obuka zaposlenika krajnjeg primatelja iz područja odnosa s javnošću s naglaskom na pitanjima gospodarenja otpadom i organizaciji konferencija za medije,
– Na gradilištu će se tijekom izvođenja radova postaviti obavijesna ploča s informacijama u skladu s EK Smjernicama o vidljivosti,
– Po završetku radova, na izgrađenoj će infrastrukturi biti postavljena spomen-ploča, koja će zamijeniti obavijesnu ploču, a u skladu sa zahtjevima EK Smjernica o vidljivosti.«
Članak 3.
Provedba Izmjena i dopuna Dvostranog sporazuma iz članka 1. ove Uredbe u djelokrugu je središnjeg tijela državne uprave nadležnog za poslove zaštite okoliša.
Članak 4.
Izmjene i dopune Dvostranog sporazuma iz članka 1. ove Uredbe stupile su na snagu 11. ožujka 2013. godine.
Članak 5.
Ova Uredba stupa na snagu osmoga dana od dana objave u »Narodnim novinama«.
